You obviously did not even read the first paragraph of the article because it says ... “Presidential candidates now are required to file the Office of Government Ethics (OGE) Financial Disclosure Form 278e with the Federal Election Commission (FEC) within 30 days of declaring their candidacy.” That requirement is not in the U.S. Constitution. Filling out financial and national security forms are not for constitutional eligibility purposes but for TRANSPARENCY and the right to know by voters who have questions in both areas ... financial and national security entanglements of the candidates.
Let the candidate who chooses to duck filing and pay a fine for Form 278e do the same with the Form SF-86 if that candidate wishes to not be fully transparent. The voters will then at least know they ducked that national security questions disclosure like they ducked the financial disclosure. It’s all about more transparency for those seeking the office of President and Commander in Chief.
And it appears many are not for more transparency from candidates running for President and Commander in Chief. I guess that fits the Progressive’s m.o. and agenda, gas light and hide truth, and instead spread misinformation ... like they are doing right now here in this thread about what I actually suggested in the article.
I can support that. Current law (5 CFR 2634.701) requires the matter to be brought to the Attorney General who may file civil action against the candidate who refuses to file.
The Attorney General can bring criminal action against anyone who falsifies information on a filing.
It is obvious to me that there is a difference between a ‘naturalized citizen’, a ‘citizen’ and a ‘natural born citizen’ since the founders differentiated between them.
The question is what additional restrictions are implied by a ‘natural born citizen’ and why are they being ignored.
So to your question, the second option ‘as long as you were born in America that makes you a natural born citizen regardless of your parentage.’ is incorrect.
Now, what exactly is a ‘natural born citizen’? I don’t know. Probably both parents being american citizens.
It is an open question, which is why nobody has the definitive answer.
I don’t know if there has ever been a court ruling on what “natural born citizen” means, as different from other classes of citizenship. I’m doubtful, since this subject keeps coming up, with nobody ever referencing a court case on the subject.
I don’t know if Congress has ever explicitly defined through legislation, what a “natural born citizen” is.
I do know, that big numbers of Freepers claim certain people aren’t “natural born” and thus not eligible for the presidency, while other Freepers say such persons, having been born in America, are natural born because of that.
The debate will go on, I’m sure.
