What happened to the John Edwards standard that cash is fungible?

The "hush money" claim is not, in and of itself, illegal. The DA is trying to make the case that campaign funds were used instead of personal money. The Edwards case argued that it was impossible to determine which pocket the money came out of, even if the personal reasons for covering up the story also had a campaign impact.

The New York DA is going to argue the opposite, that it was the campaign interests that led to spending the money, not the personal interests that had a secondary benefit.

This will be another case of the Democrat getting the benefit of the doubt while the Republican is assumed to have the worst-case motives. This is despite the fact that Edwards was cheating on his dying wife and had a child from his affair.

Agreed. Having consensual sex with someone is not a crime (even if it is a political candidate having sex with a porn actress). Paying someone to shut up about anything is also not a crime — many settlements of lawsuits actually contain provisions that require the plaintiff to not discuss any details of the case in return for payment of the settlement. Essentially that is a legal agreement to take money to shut up, exactly what Trump’s supposed crime is in this case.

I really don’t see what crime could possibly be alleged here. Trump’s behavior (if allegations were true), might be morally questionable, but certainly not criminal. Of course the facts hardly matter when the lefties think they can pin something on Trump. Facts, rule of law, etc. just don’t apply when Trump is being targeted
