There is precedent for a person who had resigned and was no longer an officer. The fact that he is an officer when impeached is enough of a hook. Trial later. Of course the removal part is then moot, but Congress has the power to taint. What good is the power if they don't use it?

Bottom line is they will not get 17 GOP Senators to vote AYE and convict. Enough know that would destroy their party.
Seems pretty simple
Article II, Section 4 provides:
The President, Vice President and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.[2]
The Senate has said back in 1799 that members are not subject to impeachments since they are not civil officers. So the Senate has confirmed you can only do this to the list above.
Will that stop them, no. So they should just start impeaching random people so they cannot hold office.
I though incitement of a riot is a felony, would that not disqualify him. They realize a real court would not convict.
I agree that they might just try to impeach after he has left office, but I doubt the Senate will agree. What probably will happen is a bill to disqualify him from being able to run. I’m not sure how they will word it so that it is not a bill of attainer but they will find a way to do it. Congress can set election laws by a simple majority vote.
There is a ticking time bomb in the helter skelter gambit the democrats are running.
In the back of their minds they are terrified that 6 months from now irrefutable evidence may surface that Biden stole the election.
If that happens Biden and company will be removed from office and every action of a Biden administration would become NULL AND VOID.
The same would apply to acts of congress or the judiciary.
The Constitution mandates three branches of government not two.
They know they have to gain a conviction while the current LAWFUL government is in power.
Once again the Constitution mandates three branches there is no constitutional government with only a lawful congress and judiciary.
Keep in mind that the democrats will be sweating bullets that irrefutable evidence may surface of Biden’s election being fraudulent - that is why they are in full-Nazi suppression mode.

They would not be impeaching a private citizen on Jan.19.
