I think that could be viewed as all votes declarer cast, the total number of votes cast and on hand at any given polling station at 23:59:59 on election day. No votes may enter a counting center after that date.

A day, is comprised of a twenty four period beginning at 12:01 AM and ending at 12:00 PM. Therefore Tuesday, election day begins at 12:01 AM Tuesday and ends at 12:00 PM Tuesday. It doesn’t matter what time you open the polls on that Tuesday, the “Election Day” will end at midnight and the day becomes Wednesday, the day after the election.

I found no definition of the term and simply expressed a reasoned opinion. Factors that went into my reasoning included the election law being enacted in the 1800’s and time zones being established in the 1900’s and some states using daylight saving time and others not. At the time the law was enacted, did it really contemplate that elections would begin at midnight, especially considering that voting had to occur before counting?
We may differ on the starting hour but agree that whenever it starts, the day is only 24 hours (with no extension for water main breaks). If a case does get accepted by the Supreme Court in the current “everything goes” era, they may rule that Election Day means Election Month.
Still not sure if that is him, but no one else with his qualifications sticks out.
This could be used a reason for the President of the Senate to NOT open and read certificates from those states. The logic being that according to US law, those are not valid certificates.
Will have to think more about this.
