If I have learned anything on FR, it is that there are many, and I do mean many, who are much more educated and experienced in various areas of law, medicine, computing, intelligence, politics, history, sciences, arts, gardening, etc. than I am. I will jump in with an opinion, but I will make sure I take their experiences into account in any final analysis.

What is involuntary denied boarding or being bumped?If we do not receive enough volunteers to accommodate all Customers who have purchased travel and have met our checkin time but do not hold a boarding pass, those Customers will be involuntarily denied boarding. We will confirm you on the next Southwest Airlines flight to your destination with seats available. If your alternative flight(s) is scheduled to arrive at your destination or stopover point within two hours of your originally scheduled flight(s), you will be compensated. We will immediately issue a check or, if you prefer, a travel voucher in an amount equal to twice the face value of your remaining one-way flight coupon(s). The maximum amount of involuntary denied boarding compensation is $675 under these circumstances.
If your alternate flight(s) is scheduled to arrive at your destination or stopover point more than two hours later than your originally scheduled flight(s), your compensation will increase to an amount equal to four times your remaining one-way flight coupon(s). In these cases, the maximum amount of denied boarding compensation increases to $1,350.

I was fairly amazed at the relationship between reporting in the news, and customer complaints to NHTSA. No way the rate of tread separation went up by a factor of 10, but the reporting sure did.
I think we're talking apples and oranges here, since the service of an airline is different from that of a car dealer. Airlines know, for instance, that x number of seats will, much of the time, go empty because people don't show up. Car dealers are different. Very, very few people pay for a car up front and don't come to get the car.
How about this? The numbers in the aforementioned CNBC article mention that 40,000 out of 650,000,000 passengers are "involuntarily" booted from a flight.
If we're going to let the free market work, then all the airline should have to do is, when a customer makes a purchase, is remind them: "Based on current trends, there is a very small chance--1 in 16,250--that you will not be allowed to *board* the flight and we will get you on the next available one to your destination."
There, the airline is "up front" about your chances. I think people will still buy the ticket. I know I would, rather than pay extra $$ for a ticket that would certainly accompany any iron-clad guarantee of a seat.
Seems that the idea that United already let him on the plane was the sticking point, and I tend to agree. Letting the passengers ON the plane and then trying to force them off was where the contract was breached.

I take that as to the passenger's advantage. Even w/o a boarding pass, they get a check. Might even save them a trip through the TSA gauntlet.
I posted Southwest's FAQ to bolster my contention that getting a cash award is as difficult as not accepting alternative offers. The airline might offer you a voucher. You are free to reject the offer. I know talk is cheap, and I don;t assume that SouthWest actually offers a check first. But any body who checks the SouthWest website will read that Southwest will immediately cut a check.
Don't get me going on the Corvair ;-)

That reminds me. There was a shop that had 50 of those Corvairs on Hwy 33 in Maryville,TN. They are all gone.
