It would have depended on whether the University officials (including athletic department) knew and participated in a cover up, either actively or by looking the other way.

Remember, the Catholic church got burned not so much for the actions of the bad priests, but for the cover up.

Institutional involvement is the key to liability.

The media and the NCAA are both wrong in the Paterno case. The testimony in the trial will show it. Why do people not blame the original perpetrators? The guy who said he saw Sandusky in the shower with the kid should have done something, not incriminating Paterno. Ssndusky was the wrong doer in this case. Sandusky is the one they should be going after. However, Sandusky doesn't have a large sum of money to go after. You can see why they go after the University and others with big pockets. Without namecalling, you know what they are.
