If he was born in the U.S. then her age didn't matter.
a lot of the same folks would have voted for Scott Brown for president 3 years ago
or Herman Cain last year
Here ya go-
§ 215. Children of citizens born in a foreign country.
It is asked whether the children born of citizens in a foreign country are citizens? The laws have decided this question in several countries, and their regulations must be followed.(59) By the law of nature alone, children follow the condition of their fathers, and enter into all their rights (§ 212); the place of birth produces no change in this particular, and cannot, of itself, furnish any reason for taking from a child what nature has given him; I say "of itself," for, civil or political laws may, for particular reasons, ordain otherwise. But I suppose that the father has not entirely quitted his country in order to settle elsewhere. If he has fixed his abode in a foreign country, he is become a member of another society, at least as a perpetual inhabitant; and his children will be members of it also.
Law of Nations/ Emmerich de Vattel / Book I / CHAP. XIX.
Of Our Native Country, and Several Things That Relate to It
This class of citizenship avoids all legal rights and claims of, by and for that child by any other nation and, to some extent, nationality.
Born in country to citizen parents is the gold standard for undiluted citizenship and would naturally be what the FFs would want for the single person granted essentially one third of the government's power and control of the military.
They were practical and loyal to what they were creating here. No way they'd go with any lesser standard for the highest office.
“Sen. Cruz told Sean Hannity on Wednesday that he believed he was eligible to be President.”
It was Hannity that declared Cruz eligible, but Cruz refused to affirm his own eligibility, IIRC.
So? He was born of the realm therefore nbC.
The assertion will be that in terms of birth status Cruz=Obama, but with the expectation conservatives will ultimately give Cruz a pass because he isn't black. As if the racist stick used to pummel democrat oppostion hasn't been hopelessly shattered due to overexploitation! Fortunately in coming years Cruz will likely gain a lot more support from certain “minorities” which will blunt that charge or association. I think it will backfire as it unfolds.
But it's never too soon to get started with a slandering of a conservative the left deems threatening; and here we have an interloper determined to prep the battlefield on FR. Disappointing.
Who here doubts Ted Cruz's allegiance to the U.S.A.? Those oposed to his consrvative values trouble me, I don't mind telling you.
No........he is NOT ELIGIBLE!
It is the mindset that you have that we are in this Constitutional crisis as it stands with Obama. Wake up and think Bob.
“Cruz is outstanding. He makes me proud.”
Making you “proud” doesn’t make him Constitutionally qualified...
Frankly, they would LOVE for Rand, who is a wonderful guy if quirky, to siphon votes from serious players like Cruz and Palin. I predict that Ted is not running, but Sarah is. Bob
It is not part of the US Constitution.
Let me see if I understand. John McCain, a child of two U.S. citizens, born in Panama because his father was an admiral in the U.S. Navy and there due to orders, would not be eligible to be president?
LOL You’re working this thing aren’t you?
John McCain was born in what was a U.S. unincorporated territory. His citizenship derives from his parents, both U.S. citizens, and from the statutory U.S. citizenship granted by Congress. He is not, however, a Natural born Citizen and has never been eligible to be President.
Precisely!
Sorry Longbow, you’re mistaken.
“Reality”
Ever heard of it?
Look, this entire NBC thing is not the cornerstone of America.
George Washington was not a NBC a she was born in Popes Creek which was at the time a British holding.
How the **** could he be a naturalized citizen when the country it self had yet to be born?
The closest definition we have to the founders was the Naturalization Act of 1790 which stated that “the children of citizens of the United States that may be born beyond sea, or out of the limits of the United States, shall be considered as natural born citizens”. (Act to establish a uniform Rule of Naturalization, 1st Congress, 2nd session, March 26, 1790, 1 Stat.L. 103 at 104, 2 Laws of the U.S., ed. Bioren & Duane (1815) 82 at 83.)
It has been interpreted and reinterpreted by various laws and court decisions ever since, with people on various sides of the issues clinging to whatever interpretation that suits their point. This one is the closest to the founders as it was in part written by Madison and other founders who were in congress at the time.
If FReepers can’t even agree on the interpretation of this issue, we shouldn’t expect any legal traction out of it.
1. Unless and until Obama submits to unbiased DNA testing we will never know who the actual father was. The VERY best BET at this time is Frank Marshall Davis,...but without definitive proof we're all just guessing.
2. If Marshall was his real father then he is a Natural Born Citizen under anyone's interpretation of any statute.
3. If he actually is a Natural Born citizen then he was and is eligible to be POTUS
4. The question then becomes did this marxist fraud claim that he was a 'foreign' student to gain admission to U.S. colleges and to receive preferential treatment, grants, and tuition plus room and board allowances he WAS NOT ENTITLED TO!??????? I have no idea on the statute of limitations on fraud and mail fraud.
5. If he was the actual son of Barack Obama Senior then he his NOT eligible to be POTUS under any scenario. Period.
Why is Ted Cruz the only hope?
