If left to stand, it is reasonable to expect that in the future, the current president or any successor, will feel justified in using this procedure any time an appointee is rejected or delayed. Taken to the extreme, a procedure designed to provide for continuity of government, effectively repeals the Senate role in selection of high level officials. This is a matter that should concern everyone, republicans and democrats alike. The question then becomes what can be done to reestablish equilibrium."Nothing. It's done. The person who has been insulted by this is Dingy Harry, as it goes to the heart of Senate rule&order, and yet who has been notably missing from this story??

A) He will fit Moochelle with that robe, etc.
or
B) The week before the 2013 inauguration of the GOP president 00bama will arrange for Kennedy’s “heart attack” or “accident” and then fit HIMSELF for that robe, etc.
Precedent and constitution be damned!

Irrelevant. The provisions of law and the Constitution are what Obama says they are when he says it. Who is going to stop him? McConnell, Boehner, the Courts? Obama is betting that no one will or can stop him.
