You are arguing for ‘legal perfectionism’ - the idea that laws can be so written to assure all situations are treated equally.

This goal was known to the Ancient Greeks.

Also known to them was the fact that a Greek City/State was too large (40,000+ voting citizens) for such laws to be possible. They accepted that human judgment was unavoidable.

That is why we have both Grand Juries and Petit Juries.

What I want to know is how this case was presented to the Grand Jury such that they did not bounce this case (and the Persecutor).

Maybe if those laws gave child molesters what they deserve, fathers wouldn't be compelled to administer their own justice.

It is my understanding that the molester broke the law, and was going to get punished, legally. That’s the way the system works.

If the father heard about it and blew a gasket, then fine, there is a legal defense for that, and most likely he never would have been charged.

However, if he had time to plan out what he was going to do, then that’s a whole new ballgame. Premeditation enters into it, and that crosses a line (legally).

What kind of precedent does that set? Anyone can ignore any law they wish? I would assume (not a good idea) that the prosecutor had a reason for pressing charges against the dad. Cigarette burns might have been one reason...

God help us dear Maelstrom. What does it say about us when a father cannot defend his innocent 8 year old daughter and anyone else’s daughter for that matter. As far as I’m concerned, if the father had killed him, I would be more than ok with it. In my grandparents day, the pervert would be shot in the street like a rabid dog. Boom! Your molesting ways are done. That’s how it was back in the day. But we’re not in Kansas anymore. If people were seriously interested in protecting their children they would put down these rabid molesters and remove them as a threat. Believe it or not, these guys get off all too often or if convicted serve less than a year. How much sense does that make? Let them out so they can resume their hobby pursuing the next generation of victims. IMHO, we have become a stupid and vacuous people, Too stupid in fact to see what is readily in plain sight. I no longer care whether one who commits such a crime rehabilitates themselves. There are some crimes for which people should be permanently removed for the general good. A lesson that has been lost upon many.

The system doesn’t work. The molester gets punished (maybe?), serves his time, early release for good behavior, and is back out on the street having a molesting good time again. IMHO, serial molesters should be put down.

Cases like this are the reason the Founding Fathers wisely saw to it that we have jury nullification. No matter what the judge tells you, as a juror you have a right to acquit if you think the law is unjust or being applied in an unjust manner.

Taking the pervert out of the house to beat him was the right thing to do. Beating him where the child could hear would have caused her further trauma. At the VERY Worst these guys should get 3 to 6 months probation.

The law may be fine when applied properly. That’s why the Founding Fathers made sure we have jury nullification. If a just law is being applied unjustly the jury can set things straight by acquitting.

In the case of an unjust law, or stupid, when enough jurors refuse to convict people charged with breaking that law it will be overturned or ignored. Alcohol prohibition is a good example. It was getting harder and harder to find jurors who would convict for the possession of alcohol.

In this case the father used good judgement by taking the pervert out to beat him rather than exposing his daughter to more trauma. He also used great restraint in not turning the pervert into a vegetable.

If the prosecutor wants to send a message to other fathers, he should offer something reasonable like 3 to 6 months probation.

While agreeing with you about the definition of assume (Makes’ an a$$ out of U & me), have you considered the prosecutor is Democrap, Liberal, and has a name which indicates a likelihood of being Jewish (extreme Liberalism is endemic in most synagogues)?

IMHO, extreme Liberals tend to do things which are motivated by Critical Theory. That is, use every opportunity to do things which will cause the public to loose confidence in America.

Only in that way can their beloved communism have any chance, as they correctly feel that as long as America stands, communism has no future.

Freerepublic is full of single-issue posters. Threads like these are magnets for internet tough guys who come to salivate over torture fantasies, thump their chests, and declare that the rule of violent mobs is a better way for a country to function than the rule of law.

They are the humiliating conservative analog of leftists who think that violent mobs who agree with them for a particular moment are the surest and fairest way to administer justice to a modern country of 300,000,000 people, and for the exact same reasons ("the system is broken," etc. etc. etc.). If it seems like halfway rational posters are outnumbered in these threads, it's just because of the process of self-selection involved in participation in them.
