So your saying that children od service members (both US citixens)born abroad in US hospitals are not American citizens?
It never has been defined by SCOTUS.
The Senate passed a resolution in ‘08 declaring McCain eligible. AS THOUGH SUCH A THING CAN BE LEGISLATED.
I take the strict view on it. SCOTUS is the final interpreter of the Constitution and this whole issue CRIES OUT for their input. With all the immigrants entering this country, the issue will be coming up again in the future.

The way they handled the Obamacare suit from VA did NOT impress me. Postponing action by refusing the “fast track” was very inconsiderate of states and companies who are having to spend millions to implement a system which gives every indication of being unconstitutional.
Those judges give every impression of being more of a social club where everybody wants to “get along” than sworn guardians of the Constitution willing to take on controversies.
They aren’t very good but we are stuck with them and presidential eligibility is ultimately their call.
Unless, like some FReepers, we want to start a civil war over it. (No thanks, personally. I’m way to old for that stuff. And the US military is far too well-equipped.)
