That makes the ATF complicit in his murder. I would not be surprised if the ATF were not more than complicit. It is entirely possible and not unlikely that the murder was done by them and the "evidence" purposely left behind.

The CBS story made it sound like they were using a paid confidential informant to sell the guns. That is pretty standard for a controlled delivery operation. Where they went wrong was that the managers at ATF ordered that the gun traffickers be allowed to successfully smuggle their guns out of the U.S.
The concept of a controlled delivery is pretty dangerous when you are talking guns. The idea of purposely letting the item go beyond your control is insane.
The fact that CBS has already gone with the story means that the White House has lost control of the story.
The transition of the story is going to provide an interesting corruption angle to what was an incompetent operation. First they arrested one of the smugglers a couple days after the shooting. Then the first press release made it sound like ATF had uncovered a trafficking ring that included criminal activity by the gun dealers. Next, a whole lot of silence followed by a pull back from a suggested change in gun laws on the border states. Then, kaboom.

No, the weapons used to shoot the BP agent were recovered at the scene. They are tracking the weapons by serial number. I bet there is no way to know how many other people (Americans and Mexicans) are getting shot with the weapons released to criminals by BATFE.
