How do we know? Root access allows you do to anything, including hiding the fact you HAVE root access and have mucked about in the device. The reality is you have NO idea if it's been exploited or not.

Furthermore, given the speed with which this exploit was used once the Government said it's legal to jailbreak your phone, there is no logical conclusion other than this exploit has been known - and tested - for quite some time.

The logical conclusion would be that hackers HAVE been using this exploit for a while, have kept their mouths shut about it (because it's a good source of money - maybe this is related to the "hacked" stories relating to the App store?), and without any traces in the OS (because it's a root level hack), there's no forensic evidence to suggest a hack.

Hopefully yes. It's been 2 days so far, and still going... I'm 100% confident malicious websites are now up and running with this very hack operating, since it's now on a "limited time" use, and gives you so much access to the phone.
