Orly was purporting to sue on behalf of an Army captain. Land (who was a conservative republican State Senator before being appointed to the bench by W) probably wanted to show that he is not hostile to the military, just to Orly. But whatever the reason, I don’t think he can do it— it’s not his money to donate, it’s the Government’s.
