Some commenters who read this post on the U.S. Attorneys decision to drop charges against Philip Cooney (MSB 10) want more clarification about that decision and the reporting in my recent article on the subject, and Im happy to oblige (sorry it took so long, but it is, after all, the last week of school). Keep in mind that this analysis is only based on my reporting on the case since last fall and a four month stint working at a legal magazine covering a variety of court cases, so nothing in here is gospel.
First of all, why drop the charges now, after so long? Channing Phillips, the Principal Assistant U.S. Attorney (essentially the second-in-command of the office), explains it sufficiently in this quote from my article:
To support the filing of a criminal charge, the standard of proof is probable cause. To obtain a conviction, though, the standard is much higher, that is, proof beyond a reasonable doubt, which is why with every case we continue to investigate, Channing Phillips, Principal Assistant U.S. Attorney, wrote in an e-mail.
Basically, its easier to charge someone with a crime than convict them of it. Thats the legal standard on the books. At some point in the discovery process (as both sides marshall their evidence and present it to each other before trial), the attorneys prosecuting the case decided that they couldnt clear that second standard, which Professor Paul Rothstein of the Georgetown Law Center told me could be represented as being more than 90 percent sure a person committed the crime.

DA candidate Cline’s Duke lacrosse “explanations” (Post 1)
(This is the first of a series of posts reporting and commenting on the many “explanations” Durham’s current cheif assisstant district attorney Tracey Cline has given concerning her involvement in the attempted frame-up of three innocent Duke students and the ongoing cover-up of that attempt.
Much that Cline has said about her involvement is contradicted by other evidence. And Cline’s own explanations of what she did and didn’t do are in some instances self-contradicting.
Cline is currently the front-runner in a four-way race for the Democratic Party’s Durham DA nomination. The primary election will be held Tuesday, May 6.

There is something even stranger going on here .
I and two of my correspondents received the first of the Justice letters with the additional information( as I read it) that IMHO was authoring the letter.
Now,we have a new letter posted identifying Immie as the culprit!
The thing is that the only link between the three recipients of my letter is that the other two were nearly side by side on my Christmas list and replied nearly simultaneously.Only someone who had dipped into my correspondence could have linked these three names.One of them hasn’t communicated with the board for nearly two years.
Ergo: It must be the hacker who is sending this stuff.
Lord knows what further damage he/she/they can wreck with fake communications.
I have to sign off at five p.m. for the weekend.Can you get this information to Tony and Baldo iif they don’t already have it.
