If the government cannot persue it's claim then I don't see how a civil case would prevail or even be considered by the court. The Government's forfeiture claim will be dismissed, because forfeiture is a criminal penalty. Civil claims for damages by injured parties can continue.

You sue the estate. Happens all the time.
