No, I don't think LE can do whatever they wish. But I also look with a jaded eye at continous claims of CR violations that are frequently used to overturn JURY decisions by liberal judges.
In this particular case CR violiations did not occur nor was "poisoned" information/evidence used in the trial, as Mudd disallowed the use of anything after the LE interview "error" occurred. So overturning the jury's decision is completely spurious.
This demand for ACLU style perfectionist standards is impossible to acheive in a human world.

SAN DIEGO (AP) - A county employee was fired for allegedly planning to sell crime scene photographs connected to the murder of 7-year-old Danielle van Dam, according to a Civil Service Commission report. A spokesman for the District Attorney's Office said prosecutors are deciding whether to file criminal charges.
Esteban Zemacki, a drafter for the Public Works Department, allegedly approached an employee in the county's photo laboratory with a plan to sell the pictures to the media and post them on the Internet, the report said. Zemacki never obtained the photographs.
Attorney Veronica Aguilar said Friday that Zemacki was joking and never intended to sell the pictures.
The commission's Nov. 20 report says Zemacki allegedly promised photo lab employee Larry Nixon "that they would make millions."
Danielle was kidnapped from her Sabre Springs bedroom last February and found dead weeks later off a rural road east of El Cajon. A neighbor, David Westerfield, was convicted in August of killing her, and the jury recommended the death penalty when he is formally sentenced Jan. 3.

Why has this one murder case created so much nasty-ness? Millions of people are murdered worldwide and you don't see "Earth Urns" and other such things being sold?
For the record, Although I would like to view these pictures, I would never purchase them off of some lowlife in order to do so - there are some really sick people out there.....

There isn't enough evidence in the Neaves case to prove one thing or another. That case is far more iffy than DW's. Only God know the truth of that situation and when and how the three year old was truly injured.
It is not the same at all.

I not only read the article, I visited the homepage of join-hands.com.
Talk about a group with an agenda. They are pushing for the US to sign the UN Children's Rights Act, and are very anti-welfare reform.
Jaded - did you visit the homepage, or just find the article through one of your "police misconduct san diego" google searches? You really should be more careful who you align yourself with. Their views on most things don't match your tin-foil hat.

Do you know what the procedure will be next Friday? I understand there's an automatic appeal in a death sentence verdict but don't know how that happens. In order to have another trial, would new evidence have to be presented or just claims the first trial was conducted improperly.
The theory of planted evidence doesn't seem far-fetched to me. How convenient those two detectives that tried to visit Westerfield unauthorized were not allowed to testify (and cross-examined). That entire episode seems like a set-up deal to me.
