As you will note in my earlier post, the Civil Rights Act should have only applied to discrimination policies that the Government supported in its own facilities or those entities that received Government largess. Businesses had to comply with Jim Crow Laws, so the Free Market impact was not part of the equation. Apple, meet Orange. Try again.
Kickass, questions for you:
Would businesses that receive government payments be allowed to discriminate against American citizens based on race or creed? Medicare, Medicaid, Food Stamps, WIC, Federal Farm subsidies, Tricare, SBA loans etc?
I pay taxes in a town. The businesses in that town refuse to deal with me because I’m white yet they get the benefit of my tax dollars for police and fire protection. Do I get a tax rebate?
Would trucking and bus companies that use Federal or state highways be able to discriminate against American citizens based on.....?
Would a pharmacy that receives no government money (I don’t think there are any) be able to refuse to sell someone medication, insulin for example, based upon their race or creed?
Your premise indicates that you think the Government can control every aspect of a Business Operation because that same Government has grown beyond its limited Constitutional responsibilities. Freedom of Association has been replaced with the Government deciding who you will associate with.
This argument isn't about Discrimination, it's about Private Property Rights. When the Government can tell you who you HAVE TO allow on your property, you no longer have ownership of that property or the freedom to live your life unencumbered.
As a Catholic, I am not “allowed” to enter a Mormon Temple.
Should I get the Government involved because I feel slighted that the LDS has discriminated against me?
This is a complicated issue that I think compares to unfettered Libertarianism. My simple answer would be that any action that endangers another, using your medication analogy for instance, would be covered under the Civil Rights Act.
However, as a Conservative, do you think a Pharmacist should be compelled by the Government to sell the Abortion Pill? To the person wanting that particular drug, your action as a Pharmacist would probably be viewed as discrimination, thus endangering the customer's physical and mental health.
As a Society, we have long ago given up our individual free will to a nameless faceless ruling authority. Although we may think we can live our lives based on our convictions, we are living life under a Progressive mindset that creeps into our lives every single day.
I realize this entire discussion is just an exercise in futility, but I appreciate your questioning. Up until a day ago, I hadn't given this topic much thought. I had no idea that it would open such a can of worms.
