The factual question is whether that is what Kelly and the others did -- or did they wrongfully suggest that some or all of President Trump's order were or are illegal?
Suppose the standard to be used is that of the FTC for misleading advertising. Would a significant minority of reasonable soldiers interpret the remarks as seditious?

Kelly's attempt to (wink, wink) hide seditious intent behind an innocuous surface meaning is transparent.

If that video is the basis of the investigation, that’s just ridiculous. A judge will pitch that case in a heartbeat.

I presume the UCMJ standard is more stringent, but imo in my non professional opinion they meet violated the statute.
