The idea that reminding military personnel of their oath and obligation to refuse unlawful orders is a UCMJ violation is simply insane.

The factual question is whether that is what Kelly and the others did -- or did they wrongfully suggest that some or all of President Trump's order were or are illegal?

Suppose the standard to be used is that of the FTC for misleading advertising. Would a significant minority of reasonable soldiers interpret the remarks as seditious?

These are questions of fact to be determined.

It seems that a significant minority of civilians interpret the remarks as seditious.

How about:

"This administration is pitting our uniformed military and intelligence community professionals against American citizens. Like us, you all swore an oath to protect and defend this Constitution. Right now, the threats to our Constitution aren’t just coming from abroad, but from right here at home.

Kelly's attempt to (wink, wink) hide seditious intent behind an innocuous surface meaning is transparent.

Worse. It’s Leavenworth and Gitmo It’s C17 flights to nowhere.

It's the conviction that counts, not the sentence. Once convicted, even if the penalty is one months pay, he's ineligible to be a federal employee for five years. Should that happen, his lawyers will find something to argue. He's a member of Congress, not an employee. But he'll use, and his political career will be over. In the 13th state in per capita military veterans, even if charges aren't filed, he hasn't done himself much good.

He knows UCMJ law. These guys don’t take bribes. They don’t get into the military for money

I mean what?

I’ve seen better bad moves playing monopoly with my great aunts.

If that video is the basis of the investigation, that’s just ridiculous. A judge will pitch that case in a heartbeat.

I don't know what they're considering charging him with under the UCMJ. The civilian standard which all 6 could be charged with is.

(a) Whoever, with intent to interfere with, impair, or influence the loyalty, morale, or discipline of the military or naval forces of the United States:

(1) advises, counsels, urges, or in any manner causes or attempts to cause insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States; or

(2) distributes or attempts to distribute any written or printed matter which advises, counsels, or urges insubordination, disloyalty, mutiny, or refusal of duty by any member of the military or naval forces of the United States--

I presume the UCMJ standard is more stringent, but imo in my non professional opinion they meet violated the statute.

I have no problem with going after Mark Kelley. Yet there are hundreds, perhaps thousands, of members of the Obama and Biden Administrations who engaged in crimes like forging the Russian collusion hoax, laundering funds to radical leftist groups through agencies like Aid for International Development, engaging in the January 6th hoax, covering up the events around the Butler, PA, assassination attempt, the "bomb" at the Democratic National Committee, etc. Ten months into the current Administration and just one indictment of James Comey, just dismissed by a district court and not even related to the major Biden-Obama era activities.

You can understand why the Left flouts the law. Just a few days ago, Antifa type thugs terrorized a pro-Trump neighborhood in San Bernadino County, CA. The Antifa rank and file have little fear of enforcement action, certainly by the state but also by the Feds.

He’s a politician. Needs to get reelected in 3 years in what could be a difficult state. Might be thinking beyond that. He retired 14 years ago, he may be thinking as a high ranking politician, not a Navy Captain

The guy was an officer also an astronaut. His cred in that realm is over.

His credibility was gone when he was exposed attempting to buy an AR-15 after trying to ban it for others.

Yes, and that’s the statute applying to civilians, all 6 of they, I suspect the UCMJ regulation is stronger.

Perhaps he sees himself as a future SecDef? Or possibly President/VP, fronting for the coup plotters?
