A handful of Liberal Judges and Trump is neutered. They can keep up the Lawsuits and ruling and keep Trump in check until the next election—then tar VD Vance, trumps people with scandals and lies. Bring forth the new Kennedy! Young, Fresh, New Englander? Great speaker, rock star haircut, no baggage and a beautiful wife to put on the covers of all the magazines. He must be scandal free, an unknown. It will be good if he’s smart (but not needed as he will be told what to do). His “New Frontier” (New Deal revamped) will sweep the nation. He will be a patriot too (maybe a war hero?). Many in MAGA will vote for him over “Hillbilly Vance”. Watch as the New Democrats will take over in the midterms, and win the White House in three and a half years. Happy Days are Here again (for the Democrat corruption machine).

The courts have ZERO role in an emergency declaration and he can ignore them. The only check on an emergency declaration is that congress can override it with legislation he cannot override, or removing him with impeachment.

The court literally has no role. The emergency is a declaration of system override. Congress is the only check on that with their ultimate superior position.

Blondie is a moron. The courts have no standing over an emergency declaration. It’s literally a president declaring he must step outside the structure of law due to a “national emergency”.

The sole remedy if it is done wrongly is through the superior branch, Congress, that can impeach him and create legislation voiding his emergency.
The courts have no black letter role in this process, not even the supremes.

Actually, it was almost never discussed during the election. And there is a good chance how he is doing it IS illegal and unconstitutional. That I’m glad he is doing it is legally irrelevant.

I was never a fan of hers but I don’t criticize her like so many here do. She has her hands full with oppositional staff to manage/get rid of, Epstein, Russiagate, and all of the lawfare lobbed Pres Trumps while trying to do his job. She deserves props at the very least for managing all if this.

The downside implications of this ruling are momentous and it is not at all clear that the Supreme Court will sustain the president's position.

If the courts can succeed substituting Article III judgment for Article I and/or Article II judgment on tariffs, the grim consequences for our economy cannot be overstated. All the trillions of dollars that Trump has induced foreign entities to invest in the United States by intimidating them over tariffs will evaporate. Our economy will decline as the opportunity cost will be immense.

The businesses, domestic and imported, that would be expected to flourish in a tariff protected environment will simply die inchoate together with the employment opportunities they might have created.

The increased revenue generated by tariffs flowing to the federal government to cover deficits will diminish or disappear altogether.

Trump's brilliant record of negotiating peace deals between warring nations will probably draw to a close because he will have lost the power to reward and punish the belligerents with tariff policy.

A positive decision in the United States Supreme Court is by no means certain, I put it no better than 50-50.

We know that the three leftists will vote reflexively against Donald Trump. Thomas, Scalia and Gorsich have already made statements that suggest they will support Trump's tariff policy. Cavanaugh is a likely affirmative vote. Barrett is a loose cannon and clearly unreliable. The Chief Justice, however, is a fifth column in black robes who will no doubt be very concerned to protect the prerogatives and power of the judicial branch, that implies an opinion that will certify supervision of tariffs by the judicial branch.

We will probably need either Barrett or Chief Justice Roberts to push the number up to five and I believe that is a tossup.

Courts since the beginning of time have reached decisions and then worked backwards to justify those decisions. A favorite technique used to reach the favored result while pretending to do justice involves selective labeling. Once the label is decided, the verdict is set.

If this matter is labeled as a question of tariff law or a question of reasonable loan of powers by the legislative to executive, the case will be lost.

On the other hand, if the case is labeled a question of foreign policy, traditionally the more exclusive province of the executive, Trump will prevail.

We shall see.

Heck, why do we need a congress if the unelected judges can make these types of decisions?

Judges of the Federal Circuit are interfering with the President’s vital and constitutionally central role in foreign policy.

Indeed nothing a left judge hates more then someone with more legal power then they do.

It’s why the left are in a group TDS mode.
