Simple mischief is 2 years and not an indictable offence its a summary offence. It has nothing to do with protesting it is a private property related crime. By denying someone access,use,or enjoyment of their private property you can be charged under 430.1.(a,b,c,d) protesting and the conduct with it is a whole different criminal code 175.1(a,b,c,d) particularly d in this case note the dwelling house part of sub section d that applies to the honking at all hours of the night in front of people homes. I would expect many code 175.1.d citations the videos from people inside of homes was clear evidence enough that sub sec. d was violated all over. Going to be hard to prove this person on foot violated anything other than 175.1.c or 175.1.a.(i) from the video ii & iii don’t seem to apply.

Individualism, accountability, freedom, ethical standards, etc. all seem to be under assault.

The bigger government gets the smaller the individual is.

This is unbelievable. I never believed Canada could become so totalitarian so fast. She has committed no crime and now will be held because she may reoffend the no crime.

Looks like as a leader they are going for counselling to commit mischief under the 430 code. Thats equal to conspiracy to commit here. There is little question that personal property rights of the residences and businesses of central Ottawa were violated by the blockade it says it right in the code you cannot blockade peoples property nor prevent access to it for the sale of goods ,services or personal enjoyment. Code 430 is a long standing code in Canada it’s not new maybe they should have thought about the consequences of not staging a lawful protest on the capital grounds with permits then the police would have been protecting them ss tge Canadian charter guarantees that exact form of protest.

Protesting is done on government property such as capital steps or in designated zones with valid permits for civil gatherings that’s how its done. There was clear evidence of violations of CA code 430 those people have property rights that were grossly violated for three plus weeks. As to Tamara if they can prove she via her actions or words convinced others to violate CA 430 they will get a conviction of counselling to commit mischief the law itself is clear something Canada does well with it’s laws they are not written in legalize like penal codes in the states which only benefit paid solicitors.

It never should have gone to the federal level. The local Ottawa LEO had an obligation to ensure order they failed in that. Nation’s are ruled by laws otherwise there is anarchy. Canada unlike the USA has a very clear set of laws. If Canadians don’t like the laws then the parliament should be turned to a new government via voting to change them. The people Ottawa were demanding to be free of the illegal occupation since Canada’s laws are clear that was easy to see. No permits, clear violation of at least 4 CA codes. Frankly it’s not up to yanks to tell Canada what they should do or not do they have laws amd the Senate today will decide if the EA stands or is revoked. There was no need fir an EA if Ottawa PD had done their job and enforced the existing codes voted on and signed into Canadian law years ago. I have friends in Ottawa they were fed up from the third day constant calls to PD ignored about noise ordinance, trespassing and mischief which is a rather serious crime in Canada. Ottawa PD utterly and thoroughly failed in their duty to the citizens of Ottawa.
