Could Sullivan dismiss without prejudice and leave Flynn open for another prosecution?

He would not have to respond if he does the action requested in the writ, ie, dismiss all charges. At that point there is no controversy and the case on which the writ was filed is over.
If he doesn’t dismiss the case, then he needs to file a response. I don’t think he wants to put his words on paper.

Sullivan is pretty arrogant.
Will he bring up the FARA violations of Flynn and son as cause for continued prosecution since the “deal” between Flynn and Mueller has been abrogated? It’s my sense that that is what he is angling for.
Once Barr declared the investigation without foundation, I think everything else that followed is fruit of a poisoned tree. But Sullivan is looking for a loophole.
However, Flynn’s FARA issues were in Rosenstein’s full scope memo as was revealed last week. IIRC, Rosenstein engineered the Flynn case to fall into Sullivan’s court.
Sullivan cannot be a prosecutor nor can he appoint one. That much is clear in the appeal for a writ of mandamus.
Sullivan has a gun to his head. It’s the only explanation that fits his behavior.
If I understand correctly, Sullivan has already been given the case. He could make a splash by issuing a decision. His justification, even if he’s overturned, would be the deal between Flynn and Mueller.
And a splash is all the media and those susceptible to being sued would want.
Sullivan has jurisdiction but the writ can take that away. He’s ordered to explain in a short time (9 days now) and then he’s pulled off the case.
If he rules which he won’t as there’s not enough time, whatever ruling will be quickly overturned as if it never happened. Flynn will still be able to sue those who broke the law in wrongfully prosecuting him. Furthermore, Wray just today opened an investigation into how the Flynn case was handled. That signals a criminal prosecution lies ahead.
The problem Sullivan has is Flynn has the goods on both Hillary and Obama, so his gag order must stay in place until the election when vote fraud will be ratcheted up like never before.
Sullivan is in the crossfire. He’s doing what he’s told.
Sullivan just hired a lawyer to represent him in this case.

2. Does he pay or Gov’t pay this lawyer?
Given the hired attorney’s background, it would seem payment is taken care of by those needing the Gag Order on Flynn to stay in place. The Gag Order stays in place as long as the case is not dismissed.
Among those known to have an interest in keeping General Flynn gagged are Obama, Hillary, Soros, and others.

I believe Sullivan is being controlled by those that want to keep Flynn gagged. By not dismissing the case, by delaying dismissal for as long as possible, the gag order on Flynn is kept in place.
The fact that Obama appeared all worked up when the news came out about DOJ dropping charges on Flynn, that appearance shows Obama is in a panic about Flynn.
What does Flynn have on Obama and Hillary that has them in a panic?
I know of some things but I’ve never seen Obama in such a sweat.
Sullivan is just a puppet of Obama and the DC deep state. He’s doing what he’s told to do. Pretty bizarre behavior and actions on Sullivan’s part.
Either his signature will be on the response papers or his brains.
I’ve heard Beth Wilkinson is one of the most ‘connected’ lawyers in DC, that the whole legal community there look at her as a force, not her per se, but the circle that moves with and backs her, the ‘enforcers’ behind her. To me that means anyone in the DC legal community that goes against her is at risk of consequences such as having a freak meteor land on them when they poke their head outside, that kind of thing.
So obviously to me there’s likely some arm twisting and “ashamed if your kids got hurt” mafia threats going down on DC judges right now.
I thought Sullivan would dismiss right away. Then we he pulled his bizarre amici and criminal contempt actions, I thought he would dismiss when he got the order from the 3-judge appellate panel.
But now I see Sullivan’s not in control. And I see Obama in a panic.
I can speculate that Wilkinson will motion for a full ‘en banc’ panel hearing meaning all the DC appellate judges, not just the three. And given the bizarre actions and the likely coercion going on, the en banc panel is probably a target of shake down if my speculation is accurate.
If what I speculate is at all accurate, I pray there are some FBI special agents that will catch these DC deep state criminals red-handed in the act of threatening judges.
