Yes his liberty was taken from him for those moments, and for what? Because someone said gun? This is getting rediculous. We are either a nation of free men our we are not. His freedom is just as valuable as ours.

why oh why do police have the authority to detain someone, in handcuffs no less, just on the word of “some guy”?

I thought he was simply leaning into the wall on the other side of that post with the black rectangle sticking out (? light fixture ?). Look at the others in the picture closer to the viewer and see the pattern—they stick out from the wall enough for a head to lean in past the top of the post.

It would be nice if the propagandist writing this article took a moment to research the law on this. Cops in California are required by law to accept citizen’s arrests. To refuse to do so would place the cop in violation of the law. At one time, cops were required to book on a citizen’s arrest but now they have the option of taking the most appropriate enforcement action based on the information provided. In this case it sounds like they released him pursuant to 849B of the California Penal Code which says there isn’t enough evidence to proceed with the arrest. The cops are only the custodians, the person making the arrest is responsible.

There’s a legal difference between being detained and being arrested. If a cop pulls you over for speeding, he is detaining you. If he thinks you may be a threat, he may cuff you or put you in the squad car. His first concern (in theory) is to control the environment.

FYI

I happen to know Andre Young and have for many many years, HE NEVER GOES ANYWHERE without ARMED SECURITY. I didn’t look at the video but you can be guaranteed he had his Armed Security with him. At the very least they were in the House, just Like they Always are at all of his homes.

This all sounds like baloney. I’m sure his thoroughly competent lawyers will settle this if they haven’t already.

If you’re in handcuffs you are arrested, as in not free to go about your business.

I believe they call that "detained". He's cuffing you for his safety until things are sorted out.

Thus the courts have ruled. Unfortunately, it has become policy, instead of a judiciously applied judgement call.

Handcuffing a well known billionaire “for officer safety” is quite a bit different than handcuffing a carload of speeding ruffians with gang tattoos “for officer safety”.

One size is applied to all, in the sacred name of political correctness.

I dream of a day when the police respond to calls of “a man with a gun” the same way they would respond to “a man with an umbrella”.

Except, of course, that keeping and bearing umbrellas is NOT specifically protected under the Constitution....
