Given the choice though; jail or accepting a pardon, she will gladly take the pardon. The spin machine would be cranked up to warp speed: Trump is out for revenge, he’s a mean SOB, etc etc

Everyone in the Trump campaighn should shut up about prospectively prosecuting That Crook, during the campaign, and just DO IT in the event of a win.

“if she loses, we might see her get charged so Obama can pardon her...”.

Per Guilliani, they can open the case AFTER Trump takes over. Going through the process to get to the point of finding her guilty will probably take 2-3 years the way the gubmint moves. Should Hitlary then be found guilty, odumbo who have NOTHING to say.

As slow as the investigations have been, trial would be even slower years. Then you have appeals.

“Obama will pardon her and others”
How can she be pardoned for something she has not been charged with?

when Obama leaves the white house he is probably going to pardon a lot of people that worked for him. I would not be surprised if there are over 1500 pardons that are blanket pardons.
I would be surprised if this was the case. I think Obama would view this as a stain on his legacy, and other than sticking it to the US that seems to be one of the few things he cares about.

But even if so, a Republican administration with access to all the documents that are being witheld now could still do a big service to the country by looking into what was actually done, and pointing out that were the individuals not already pardoned, they'd be going to jail.

A Presidential pardon can be granted for any crime or criminal actions at any stage of the process: after commission, before indictment, after conviction. Case in point: Gerald Ford and Richard Nixon.
