Cruz either has a CRBA from the State Department or he does not. For a citizen born outside the United States that document is the proof that you were born as a citizen of the United States, just as a US birth certificate is the proof that you were born here as a citizen if you are born in the United States, as I have written on before. A CRBA is proof that you were born a U.S. citizen, but U.S. citizenship does not flow from the CRBA. A person (like Cruz) who is eligible for a CRBA (that is, a person born abroad to a U.S. citizen) is a U.S. citizen from birth, regardless of whether or when his parents fill out the consular form to obtain the CRBA.

Donald Trump dramatically escalated his feud with rival Ted Cruz on Monday, threatening to sue the Texas senator over his eligibility for office if he does not retract alleged **lies** about Trumps positions... If he really believes Cruz is not eligible, why would he NOT sue if Cruz retracts "alleged **lies** about Trumps positions." Either he doesn't really believe Cruz is ineligible and is lying to stir up the LIV attacks against Cruz, or he believes that Cruz is ineligible but doesn't care about it, as long as Cruz doesn't hurt his feelings.
