A SCOTUS decision is very remote, at this point (as best I can tell without seeing all the papers myself).
If they do decline to grant cert., then we’d have to see if they give any hints as to IF there is a problem that should be addressed and BY WHOM.
If they simply refuse the case and don’t give any reasoning, then we’re where we are now: we don’t know for sure how to define “natural born citizen,” we have no established, non-secret, non-private process for determining if a President-elect is a “natural born citizen,” and we have no settled procedure or grounds upon which to challenge the eligibility of a President-elect.
At that point, we can only look to the Congress to address some of those deficiencies.
But none of that would affect Obama’s eligibility.
