Forgive my ignorance, but why has this come to a lawsuit? Isn’t it an absolute, written-in-stone requirement of all candidates for president that they prove they’re eligible for the office according to the restrictions set out in the constitution? Somehow, it seems to me this should be a no-brainer, and the documents should have been on file throughout the past year and more.

If this makes it through the court after he's sworn in, and it's determined that (do nothing) Obama isn't a natural born US Citizen, will Biden be President and Pelosi appointed Vice President?

Their reasoning for requesting a protective order is that revealing the information (birth certificate, passports, citizenship in other countries) would “cause a defined and serious injury” to Obama and/or the DNC. They say revealing these documents raises a “legitimate privacy concern” and the above mentioned risk that “particularly serious embarrassment will result from turning over the requested documentation.” (emphasis added) Then they claim Berg has no standing to ask for it.

Is the above quote from the answer from Obama? Is this now part of the record? Did Obama's lawyers answer with this statement? I know- read first- ask questions later. I will go to the site and read up- then come back and see what others are saying...

When and where did he claim this? This, as a quote, demands a verifiable citation.

The language contained in the protective motion, etc. regarding “specific injury” and the like should not be regarded as any admission. It is pretty standard stuff in any discovery dispute in a civil suit.

However, my interest has always been piqued by Obama’s apparent inability or unwillingness to produce something as simple as a birth certificate. If the one displayed before on Daily Kos is not a fake, then why not produce the damn thing in court and then laugh and jeer at Berg as he is thrown out of the court house door? On the other hand, if it is a fake, I can readily understand the refusal to produce it in court and thus vouch for it under oath.
Personally, I have come to believe it is quite possible Obama was not born in Hawaii.
