A SYDNEY council has cancelled a town hall booking for a radical Islamic conference, claiming its host, Hizb ut-Tahrir, has incited hatred at similar evens in the past.

The Sunni Islamic group advocates the revival of the Muslim caliphate, an Islamic superstate that once stretched across the Arab world to Spain.

Bankstown City Council says one of the group's speakers made hateful comments about women and challenged the authority of the Australian Government at a previous event at Bankstown Town Hall.

"They made strong, negative comments inciting hatred towards women," Bankstown Mayor Tanya Mihailuk said. "Much stronger than Sheikh (Taj al-Din) al-Hilali's comments," she said of the controversial Sydney cleric who caused a storm last year when he likened scantily clad women to meat.

The organisation, whose name means "The Party of Liberation" requested a booking for a conference at the town hall last year titled: "The Illegality of the state of Israel," which was turned down by the council.

"The (event's) promotional material was shocking," Cr Mihailuk said. "It showed daggers with blood put through the state of Israel.

"It would have certainly breached our conditions of hire in that it would incite racial vilification and violence."

The spokesman for Hizb ut-Tahrir, Wassim Doureihi, rejected the claims as "baseless".

He denied hateful comments were made by the group's speakers and said the party had no designs to overthrow the Australian Government.

"What we are advocating is political change in the Muslim world. We're not advocating political change in this country," he said. "We're not engaged in terrorism, nor do we advocate terrorism.

"ASIO is very familiar with our work and we've met them on a number of occasions."

Of the Khilafah Conference that was scheduled for late January, he said: "We're asking the Muslims and the wider Australian audience to play a pivotal role in affecting peaceful political change throughout the Muslim world."

Mr Doureihi said the organisation advocated change by peaceful means only.

Yet a section on its website, www.risala.org, urges Somali militants to wage jihad against foreign troops.

"O Muslims, Hizb ut-Tahrir urges you to give victory to Somalia; this is an obligation, commanded by Allah, the Exalted," it reads. "If you do not go forth, he will punish you with a severe punishment, and will bring in your place a people other than you."

Cr Mihailuk said the council initially accepted the conference booking because it was made under another name.

Hizb ut-Tahrir is not classified as a terrorist organisation in Australia.

AS SUE Clifton tied together her broken life jacket on Tuesday, she had no idea she was about to face her "worst nightmare" — stranded in open water off a Malaysian island for three hours.

Ms Clifton and her friends Kimberley Chinpoy and Prue Vence, all from Sydney, are lucky to be alive after the boat they were travelling in capsized in rough seas off Sabah.

Mariamah Kawrai, the wife of a rescued tour guide, drowned in the accident. Nine others were rescued in the hours after the accident. Another tour guide, Robert Ernest, 26 was found treading water at dusk yesterday, Malaysian police said.

Mrs Chinpoy, a New Zealand citizen who is five months pregnant, was trapped under the vessel but managed to swim to the open sea with Ms Vence before being picked up by another boat. But Ms Clifton was left in the water as it was too dangerous for the boat to reach her.

Ms Clifton told The Age how she made it through what she described as a "horrendous" ordeal and her "worst nightmare" after she was left stranded in the water.

The women were one week into their trip when the accident occurred. On Tuesday they boarded the boat from Sandakan to the island of Libaran, on their way to the region's famed orang-utan sanctuary.

About 11.30am, the boat capsized after the captain ignored a meteorological department warning against all marine activities.

Ms Clifton was separated from her friends after they were rescued by another boat. "It was too dangerous for them to come back and get us," she said.

She was in the water for about three hours before being washed to shore with four other tourists and the boat's driver.

A predator who sexually assaulted a 13-year-old girl in a Sydney park might have been caught on a CCTV surveillance camera.

Detectives are waiting to interview the girl, who had been walking through a park on Castle Howard Road, near the M2 in Cheltenham, about 7.30pm when the man approached her.

Police could not confirm a report the attacker called himself Gus.
But after the assault he fled towards an M2 overpass.

The shocked girl was taken to Randwick hospital and treated.

Detectives and dog squad officers searched the area and CCTV footage is being examined.

A police spokeswoman said the girl would be interviewed by detectives today.

The attacker has been described as being in his late teens to early 20s with an olive complexion, muscular build and wearing black jeans and a red top.

While concerns grow over the $11 billion privatisation bid for Qantas, the airline has also had to deal with allegations this week of a cover up after it emerged that a packed passenger jet flew with a huge hole torn in its side.

This picture shows the damage sustained by Qantas flight QF5 on March 8 last year after it was damaged by a blown tyre short after take-off.

The flight was travelling from Singapore to Frankfurt with 408 people on board.

Qantas chief Geoff Dixon denied there was any cover up, or danger for staff and passengers.

"There was no risk to passengers or crew at any time," he told the Seven Network.

"The incident was reported to the ATSB (Australian Transport Safety Bureau) and CASA (Civil Aviation Safety Authority).

"Qantas also undertook its own investigation and provided its results to the Australian regulators, and to the air accident investigation bureau of Singapore.

"All decided that the incident did not warrant further investigation."

CASA spokesman Peter Gibson told Seven: "It's certainly not a matter of a covering anything up.

"It's about making the right safety judgments, and we believe that was done."

CASA ruled there was no risk to passenger safety.

Body found near Indonesian plane wreckage

Indonesian police say they have found a body floating close to where the tail of a missing passenger jet was discovered, but they can not confirm it is one of the plane's passengers.

The plane was carrying 102 passengers when it disappeared from radar screens during a flight from Surabaya to Java on New Year's Day.

Officials say a fisherman found a piece of the plane's tail close to a beach on the island of Sulawesi this morning.

Its serial number matches that of the missing jet.

"We found a female dead body in the south edge of Nusantara Port Pare Pare," said police official Simon Benteng.

A House committee released a report today concluding former National Security Adviser Sandy Berger went to extraordinary lengths to compromise national security and that the Department of Justice could not assure the 9/11 commission it received requested documents.

Rep. Tom Davis of Virginia, ranking Republican member of the House Oversight and Government Reform Committee, said his staff's investigation reveals Berger "compromised national security much more than originally disclosed."

"It is now also clear that Mr. Berger was willing to go to extraordinary lengths to compromise national security, apparently for his own convenience," Davis said.

As WND reported, a newly released investigation report by the National Archives and Records Administration showed President Bill Clinton signed a letter authorizing Berger's access to the classified documents.

Last year, Berger plea bargained a criminal sentence on the charge of unlawfully removing and retaining classified documents. A judge gave him no prison time, a $50,000 fine, 100 hours of community service and a ban from access to classified material for three years.

Davis said the 9/11 commission "relied on incomplete and misleading information regarding its access to documents" Berger reviewed.

The commission was never told Berger had access to original documents that he could have taken without detection, Davis stated.

"Mr. Berger's review of documents did not conform to the usual requirements for reviewing classified documents in a secure facility and under strict supervision," he said. "The archives staff's failure to contact law enforcement immediately and their contacts with Mr. Berger about the missing documents compromised the law enforcement effort."

Davis said the "compromised law enforcement effort contributes to reduced confidence that the 9/11 commission received all the documents it requested."

"The execution of a search warrant before Mr. Berger knew there was an investigation would have either located additional documents or enhanced confidence that he stole no others than those he admitted to taking," he said.

Davis also said the public statements of the former chief of the public integrity section, Noel Hillman, were "incomplete and misleading."

"Because Mr. Berger had access to original documents that he could have taken without detection, we do not know if anything 'was lost to the public or the process,'" Davis said.

The congressman contended the Justice Department's assertion that Berger's statements are credible after being caught is "misplaced."

"One wouldn't rely on the fox to be truthful after being nabbed in the hen house," Davis said. "But the Justice Department apparently did."

Davis also referred to revelations last month from the National Archives investigation, which revealed Berger left stolen highly classified documents at a construction site to avoid detection.

The document upon which Berger focused was the National Security Council's "Millennium After Action Review" on the Clinton administration's handling of the al-Qaida terror threats in December 1999. Then-Attorney General John Ashcroft testified before the 9-11 commission about the millennium report, urging the panel to ask why the document's warnings and "blueprint" to thwart al-Qaida's plans to target the U.S. were ignored by the Clinton administration and not shared with the incoming Bush security staff.

Jonesboro shooter found with gun, pot, while with crossbow killer

FAYETTEVILLE -- One of two boys convicted in the 1998 Jonesboro school shootings was found with a loaded gun and marijuana on New Year's Day, along with his roommate, a man incarcerated for three years as a teen for killing his father with a crossbow.

Mitchell Johnson, now 22, was 13 when he and classmate Andrew Golden killed four girls and a teacher in a March 24, 1998, shooting at Jonesboro Westside Middle School. Justin Trammell was 15 when convicted of killing his father in 1999.

Trammell was driving Johnson's 1991 Ford Econoline van a few blocks from their residence at the Appleby Apartments, 2918 N. Gregg St. in Fayetteville, when a sheriff's officer noticed it weaving about 8 p.m. New Year's Day. Washington County Deputy Jak Kimball said Cpl. Steven Hulsey smelled marijuana and asked to search the van.

"That's what you're looking for," Johnson said when Hulsey found the marijuana, according to the officer's report. Johnson told the officer there was also a gun in the van and Hulsey found a loaded 9 mm pistol in the rear of the vehicle, the report said.

Johnson was arrested and charged with carrying a prohibited weapon and possession of a controlled substance, both misdemeanors. He was released on a $1,000 bond -- he listed Trammell as his "brother" on his release papers -- and faces a Jan. 26 arraignment.

"He was probably only in (jail) for a couple of hours," Kimball said.

Trammell was cited for careless driving and not arrested, Kimball said. He is due in court the same day.

Neither Johnson nor Trammell have criminal records because they were juveniles when they committed their crimes. If Johnson had a criminal record, he could have been charged with a felony, Kimball said.

Kimball said authorities were aware Johnson was living in the Fayetteville area, but that they hadn't had any previous encounters with him.

"We knew he was around," Kimball said.

When Trammell was released from prison in 2002, a judge admonished him to "lead an exemplary life." After violating terms of his parole, he was reassigned to a juvenile facility until his 21st birthday, July 4, 2005.

Trammell was the first person sentenced under a new law in Arkansas that allowed the blending of adult and juvenile sentences -- changes in the law passed in response to the Jonesboro school shootings.

Gov. Mike Beebe, who as a state senator backed the blended sentences law, said he was surprised by Johnson's arrest.

"Those people who find themselves in that situation sure ought to have the attitude that they take advantage of it and do right," Beebe said. "I'm a little surprised and obviously it's a terrible thing if you've got somebody who in effect gets a second chance and doesn't take advantage of it."

Dustin McDaniel, who was sworn in as attorney general Tuesday, said he was glad police were not injured during Johnson's arrest. McDaniel, a former police officer, was a state representative from Jonesboro before being elected the state's top law enforcement officer.

"The great frustration for a lot of people, including me, about the nature of the juvenile system was that these young men were permitted to walk from jail without even being considered convicted felons," he said. "The idea that potentially more people could be endangered is exactly what everyone had been afraid of."

Brent Davis, who prosecuted the 1998 case against Johnson and Golden, said the fact Johnson has a clean criminal record shows the law was "woefully inadequate" when dealing with juveniles who commit brutal crimes.

"It's not like he's on parole or probation or any restrictions, as odd as it seems, in light of what he's previously been involved in," Davis said.

Mitchell's arrest and "the fact that his past is not considered is just another example of the inadequacy of the law that we had to deal with," Davis said.

Michael Trammell, 38, of Benton County, died Sept. 26, 1999, after an arrow from the crossbow pierced both of his lungs. Justin fired the fatal bolt when his father interrupted him as he was planning to run away from home.

Justin Trammell pleaded guilty to first-degree murder in June 2000.

Johnson's mother, Gretchen Woodard, said last summer as Johnson's 21st birthday approached that her son would leave Arkansas and was considering becoming a minister.

Golden, who was 11 at the time of the shootings, remains incarcerated; he is eligible for release on May 25, his 21st birthday.

Meanwhile, Golden's grandfather, Douglas Golden, 70, died Monday in his home. A cause of death wasn't immediately known. According to police, the boys stole guns from the elder Golden's home for use in the school attack. It wasn't known whether the younger Golden would be allowed to attend the funeral.

Federal Trial Under Way In Weapons Case

FAYETTEVILLE -- The trial of a Washington County man charged with having illegal machine guns is under way despite a series of fits and starts over what the defense can say in front of the jury.

Hollis Wayne Fincher, 60, a lieutenant commander of the Militia of Washington County, is charged in federal court with possessing three homemade, unregistered machine guns and an unregistered sawed-off shotgun.

After a half-dozen sidebars and a couple of sessions in chambers, U.S. District Judge Jimm Larry Hendren sent the jury home early Wednesday so he could again meet with lawyers to discuss what can and can't be presented to the jury.

Before opening statements, Hendren ruled the defense can present evidence the machine guns and shotgun were necessary for a state militia. He also wants to hear any such evidence or arguments before they're presented to jurors to determine if such evidence is in line with established legal precedent so jurors will not be misled or confused about the law.

Hendren said the courts have found there's no private right under the Second Amendment to keep a machine gun; the Second Amendment gives a collective, not individual, right to keep and bear arms; and, the Second Amendment is aimed at protecting state-sponsored militias.

Membership in a loosely formed citizen militia is not protected, he said.

The defense has based its case largely on a Second Amendment argument that the government can place limits on the possession of military weapons by individuals or groups but cannot prohibit the possession or use of any weapon that has any reasonable relationship to the "preservation or efficiency of a well-regulated militia."

The sides have vastly different ideas of what constitutes a militia.

Fincher's attorney, Oscar Stilley, argued Fincher has relied on being able to use the Second Amendment as a defense since the charges were filed. Stilley said he should be able to make constitutional arguments directly to the jury.

Hendren said the defense will be allowed to make a sufficient record for appeal purposes but he won't allow arguments concerning various interpretations of the Second Amendment to be presented to jurors.

Twelve jurors and two alternates were seated by midday Wednesday and opening statements were made in the early afternoon.

During an opening statement interrupted several times for sidebar discussions about what he could and couldn't say, Stilley told jurors Fincher sent letters to state and federal officials in 2002 telling them he had the guns, that he thought they were legal because they were for use by the militia and asking them to inform him if they thought his position was wrong. Fincher didn't get a response and assumed he was not breaking the law, Stilley said.

"Mr. Fincher has never denied that he kept machine guns," Stilley said. "Nobody told him that he can't have those guns."

The government's first witness, Wade Vittitow, a special agent with the Bureau of Alcohol, Tobacco and Firearms, told jurors he started looking at Fincher in 2006, after a report about the militia group appeared in The Morning News.

A check of the National Firearms Registry showed Fincher had not registered any guns, Vittitow said.

A confidential informant was used to infiltrate the group and a subsequent search warrant netted up to 15 guns that should have been on the federal firearms registry, Vittitow said. Agents also found parts, templates for making parts for machine guns from scratch, belts of ammunition and a partly assembled submachine gun.

Fincher was arrested Nov. 8 by federal agents. He remains in federal custody in lieu of $250,000 bond.

Mexican alien smugglers plan to pay violent gang members and smuggle them into the United States to murder Border Patrol agents, according to a confidential Department of Homeland Security memo obtained by the Daily Bulletin.

The Officer Safety Alert, dated Dec. 21, warns agents that the smugglers intend to bring members of the international Mara Salvatrucha street gang also known as MS-13 into the country for the deadly mission.

"Unidentified Mexican alien smugglers are angry about the increased security along the U.S./Mexico border and have agreed that the best way to deal with U.S. Border Patrol agents is to hire a group of contract killers," the alert states.

MS-13, which has a strong base in El Salvador , is considered by the FBI to be one of the most dangerous gangs in the United States , with more than 20,000 members.

Gang members have been found in 33 states and connected to murder, racketeering, assault, rapes and extortion. Last January, Immigration and Customs Enforcement raided six cities and made more than 100 arrests of MS-13

"The president still acts like Mexico is a friendly neighbor, when in reality it's the complete opposite," said Andy Ramirez, chairman of Friends of the Border Patrol, a Chino organization that supports border agents. "Border Patrol agents' lives are in extremely high danger, and yet the public isn't notified. When are they going to realize that threats against our law-enforcement officers are threats against this nation?"
