I still get physically ill when contemplating the acts of Susan Smith...I was stunned when they didn't go for it, and can only think they felt a jury wouldn't go for it. I disagree.

Dusek reminds that the jurors listened again to the Redden tape.
He concludes Westerfield's acts so heinous they deserve death.
Mudd back up--addressing motion to dismiss. Says closed hearing matters brought up by Feldman were held so media would not have information the judge felt would taint the jury. People deprived of evidence withheld that was very damning--very damning, he repeats--and the jury never heard it. Defendent had zero, zip, nada, etc harm from the actions of the officers. Motion denied.
Now Mudd weighing in on pundits--heavy scorn in his voice. Sarcastically talks about the pundits informing of the law, etc and their expertise. NONSENSE, says Mudd.

Says physical evidence found is convincing of defendent's guilt.
Evidence establishes well beyond any reasonable doubt that the evidence was from Danielle. Hair length consistant with recent passport photo and haircut.
Missing teeth indicate physical trauma and are very important.
Mudd cites the testimony of the fingers in the mouth incident and says it is disturbing.
Possession of child pornography weigh against the defendent.
