  • OSHA Suspends Requirement That Employers Report Vaccine-related Injuries

    The Epoch Times ^ | May 31, 2021 | MATTHEW VADUM
In order to encourage American workers to get vaccinated, the Occupational Safety and Health Administration (OSHA) has suspended the legal requirement for employers to report work-related injuries resulting from vaccinations aimed at combating the CCP virus that causes the disease COVID-19. This suspension of the law by OSHA does not change the fact that employers may be held liable under workers’ compensation laws or under civil personal injury laws, according to the nonprofit group Liberty Counsel. Earlier in May, the website of OSHA, an agency within the U.S. Department of Labor (DOL), stated that employers could be held liable if...
  • Unlike Big Pharma or Government, Businesses that Mandate Covid Vaccines are LIABLE for Adverse Reactions

    NOQ Report ^ | 05/18/2021 | JD Rucker
The CDC, OSHA, and common sense are clear. Businesses that mandate their employees, whether new hires or current, to take the Covid-19 vaccines as a requirement for employment are liable for lawsuits if ANY adverse reactions occur. As we’ve documented many times on NOQ Report, there have been a slew of reports of major negative reactions to the Covid-19 vaccines, including paralysis, brain clots, and death.Mainstream media is doing their part in not reporting on these as much as possible, covering up anything that goes against the accepted narrative regarding these vaccines. But as the cases mount up, even the...

Facebook CEO Mark Zuckerberg is once again calling for reform of the Communications Decency Act (CDA) Section 230 – as he once is again appearing before a US Congress committee. Zuckerberg’s testimony on Thursday before the House Energy Committee revealed that Zuckerberg is proposing replacing automatic immunity from prosecution for user generated content with platforms like his own demonstrating that they have implemented “adequate” moderation and censorship systems. He said that these systems would be used for “identifying unlawful content and removing it.” The thought behind this seems to be to convince critics that tech giants are doing everything to...
  • AstraZeneca to be exempt from Coronavirus vaccine liability claims in most countries

AstraZeneca has been granted protection from future product liability claims related to its COVID-19 vaccine hopeful by most of the countries with which it has struck supply agreements, a senior executive told Reuters. With 25 companies testing their vaccine candidates on humans and getting ready to immunise hundred millions of people once the products are shown to work, the question of who pays for any claims for damages in case of side effects has been a tricky point in supply negotiations. “This is a unique situation where we as a company simply cannot take the risk if in ... four...
  • U.S. insurers explore officer coverage as police reform debate rages

U.S. insurers and brokers are starting to craft professional liability coverage for police officers, spurred on by signs that policymakers in some cities and states want to use a financial stick to curb police misconduct. They see a potential market opening up after a New York state lawmaker this month introduced legislation, which would require individual officers to carry liability coverage for lawsuits alleging excessive force, abuse or other misconduct. “I think we’re in a new world,” said New York-based Mark Turkalo at the insurance brokerage unit of Marsh & McLennan Companies Inc, about the trend. Turkalo said the firm...

President Trump is considering creating a panel to oversee complaints of bias against conservatives by social media platforms in a move that would likely spark pushback from tech companies. The plans are still being mulled, people familiar with the matter told The Wall Street Journal, but options could include the creation of a formal White House commission on the allegations. “Left-wing bias in the tech world is a concern that definitely needs to be addressed from our vantage point, and at least exposed [so] that Americans have clear eyes about what we’re dealing with,” a White House official told The...

CHARLESTON, W.Va. — As small businesses reopen around West Virginia, members of the National Federation of Independent Businesses West Virginia are expressing concern of frivolous lawsuits that may open up as a result of openings. Gil White, the state director for the federation appeared on a recent MetroNews ‘Talkline’ and said 68 percent of members are concerned increased liability because of COVID-19 virus as employees may feel forced to come back or say protections were not taken. White said there is a difference between negligence and everyone doing the best they can, and believes the latter is true. “There is...

The costs of the pandemic keep piling up. Hundreds of millions of Americans are on lockdown, a record 16.8 million have filed unemployment claims, nearly 15,000 Americans have died so far and the death toll is growing exponentially by the day. Congress has passed three coronavirus relief bills totaling $2.3 trillion, and more might soon be in the works. Somebody has to pay for this unprecedented damage. That somebody should be the government of China.

State Rep. Gary Eisen, R-St. Clair Township, introduced House Bill 4975, which would revoke governmental immunity from lawsuits arising from injuries sustained on government property where guns are banned. Eisen is also the sponsor of House Bill 4976, which would make a government, business or individual that designates a property a gun-free zone responsible for the safety of individuals who enter it. < . . . > Eisen said part of the rationale for his bill lies with a report that 98% of mass public shootings happen in gun-free zones. The Washington Post reported that President Donald Trump recited that...

The maker of the gun used in the Sandy Hook, Connecticut, school shooting asked the U.S. Supreme Court Thursday to hear an appeal of a state ruling that revived a wrongful death suit against the company. Remington Arms asked the nation’s highest court to hear an appeal of a March Connecticut Supreme Court ruling that reinstated a lawsuit against it over marketing messaging for the Bushmaster rifle that gunman Adam Lanza used in the 2012 shooting, Reuters reported. Remington has argued it is protected by the 2005 Protection of Lawful Commerce in Arms Act (PLCAA), which prohibits civil actions against...

Enough is enough. The U.S. Justice Department needs to immediately open a criminal civil rights investigation of Antifa, an affiliation of radical activists and left-wing groups whose name, ironically enough, is short for “anti-fascists.” Its attack on journalist Andy Ngo was beyond the pale. Federal law enforcement has an obligation to stop any extremist organization that is apparently organizing and precipitating violent attacks, especially if state and local authorities seem reluctant to take action against what has all the makings of a domestic terrorist organization. We cannot have any confidence that the political leadership of the city of Portland will...
  • A new Senate bill would fundamentally change the internet as we know it

A new bill in the U.S. Senate could cause the internet as we know it to cease to exist by holding major tech companies like Facebook or YouTube liable for anything posted on their platforms. On Wednesday, Senator Josh Hawley (R-MO) introduced controversial legislation that would amend Section 230 of the Communications Decency Act (CDA). Known as the Ending Support for Internet Censorship Act, it has caused bipartisan backlash on how it would affect tech companies, content creators, and everyday users. Tech companies like Twitter or YouTube currently have protection under Section 230 against being held liable for what users...
  • This Bill Would Make Private Individuals, Businesses Pay the Price of Government Shutdowns

Over the past 40 years, the federal government has shut down 21 times due to political disagreements over funding. Most of America, including the government itself, goes largely unaffected by a government shutdown. But for federal workers who are furloughed or required to work without a paycheck, a lapse in government funding can cause financial problems, leading some to default on debt or miss rent payments. This can result in real hardships up to and including eviction. The blame for this rests squarely on the lawmakers who fail to fund the government. Remarkably, though, some Democrats in Congress believe that...

Citing concerns about possible pension liability, Larkspur officials this week took the first step toward severing the city’s membership in the Central Marin Sanitation Agency, a wastewater organization it helped form in the late 1970s. The Larkspur City Council agreed Wednesday to give up the city’s seat on Central Marin’s six-member board of directors, which governs the infrastructure that treats sewage collected from Larkspur and other nearby areas. The council will vote on formal resolutions declaring the city’s severance at future meetings. But Larkspur’s voice won’t be completely flushed down the drain when the withdrawal is finalized, one of the...
  • Defensive Medicine: Evidence from Military Immunity

We estimate the extent of defensive medicine by physicians, embracing the no-liability counterfactual made possible by the structure of liability rules in the Military Heath System. Active-duty patients seeking treatment from military facilities cannot sue for harms resulting from negligent care, while protections are provided to dependents treated at military facilities and to all patients—active-duty or not—that receive care from civilian facilities. Drawing on this variation and exploiting exogenous shocks to care location choices stemming from base-hospital closures, we find suggestive evidence that liability immunity reduces inpatient spending with no measurable negative effect on patient outcomes.

The mass shooting that killed 17 students and staff members at a Florida high school thrusts the Broward County school system into a hornet's nest of legal issues including the complexities of a crime scene, the privacy of student records, and the threat of liability. And it's fueling what could become a national debate over the proper response by school and mental health professionals for those deemed at risk of violence. (Read more at the link)

A Fresno State professor sued by students after interfering with their anti-abortion messages on campus says he did nothing wrong – and didn’t pay $17,000 in a settlement despite an announcement made by Alliance Defending Freedom on Thursday. “I admitted absolutely no wrongdoing, and I did not have to pay a dime,” public health professor Greg Thatcher said Friday. The costs were covered by his insurance company through the National Education Association, he said.

Despite the left’s attempt to deny it, some anti-Trump protesters are indeed paid to show up — including those from a growing number of tech companies who are paying their employees to participate in anti-Trump rallies. The San Francisco Chronicle reported on Saturday, in an article titled “Bay Area demonstrators may be paid to protest, by employers,” that the “common accusation lobbed at liberal protesters” that “they’re being paid to protest” is at least partially based in fact. According to the Chronicle, “an increasing number of companies have unveiled policies that allow employees to take paid time off work for...

The recent firing of Mike Flynn is par for the course of any new administration. When a new POTUS comes into office, he must evaluate the performance of his subordinates. Even more difficult is the fact that POTUS must insist that their performance and integrity [whatever that might mean] meets the standards that POTUS has set for himself and his WH. Lt.Gen. Mike Flynn has been a loyal soldier. He did what he was supposed to do in order to facilitate Trump’s ascendancy into the WH. However, rumors were floating around that the National Security team in the WH was...
