Texas prosecutor Mike McCrum says the grand jury that indicted former Texas Governor Rick Perry has made two mutually exclusive factual findings. The grand jury, McCrum says, has alternately declared that Perry's public statement threatening to veto a spending bill was 1) An official act; and 2) Not an official act. The significance of this will be described below. First, though, recall that there are two Counts in the indictment against Perry: COUNT ONE: Abuse of Official Capicity. This count alleges that Perry abused the office of Governor by "misusing" government "property" (the veto is the item Perry allegedly misused)...

Former Gov. Rick Perry presented an “angry man” persona at a news conference on Wednesday when responding to a court ruling on the abuse of office indictment against him. He needn’t have been so angry. His lawyers are making headway. Judge Bert Richardson ruled Tuesday that the case can move forward, but he also noted weaknesses in both counts of the indictment. Perry’s lawyers said they’ll appeal the ruling, while at the same time taking advantage of Richardson’s suggestion that they reword their motion to dismiss one of the counts and try again.

AUSTIN — The prosecutor handling the indictment against Rick Perry is pressing a judge not to dismiss the case, arguing that doing so would amount to making an exception for the governor. In a series of filings made public Friday evening, special prosecutor Michael McCrum argues the only way to deal with the allegations against Perry is to let the facts come out during a trial and ask a jury to decide the governor’s fate ... In seeking a dismissal of the case, Perry’s defense team has argued the indictment violates Perry’s right to free speech, defies the separation of...

BEGIN TRANSCRIPT RUSH: Mr. Snerdley walked in and said, "Boy, this thing with Rick Perry, can you believe what a farce?" It's not a farce, folks. Now, I'm not gonna be getting to Rick Perry right off the bat here, but I wanted to mention something about it to get it on the table. It's not a farce. It isn't a joke. Sadly, it's not even a laughing matter. This is dead serious. Not that he's done anything wrong. What's dead serious about this is the Democrat Party and their ongoing effort to criminalize political differences or opposition. All the...

The indictment of Gov. Rick Perry by a grand jury in Travis County, Texas, is part of a power struggle that originates with a serious crime, albeit not one committed by Gov. Perry. That crime, as everyone knows by now, is drunk driving, and it was committed by Travis County District Attorney Rosemary Lehmberg. When Travis County District Attorney Rosemary Lehmberg, Democrat, was arrested and charged with drunk driving on April 12, 2013, her blood alcohol level measured .23. That is just shy of three times the legal limit in Texas, which is .08. According to the Texas Alcoholic Beverage...

AUSTIN — Texas Gov. Rick Perry said Saturday that the indictment against him was an “outrageous” abuse of power and vowed to fight it. “This indictment amounts to nothing more than abuse of power and I cannot and will not allow that to happen,” Perry said at a news conference on Saturday. Perry spoke a day after a grand jury indicted the Republican on two felony counts of abuse of power for making good on a veto threat. He dismissed the prosecution as a “farce.” A special prosecutor spent months calling witnesses and presenting evidence that Perry broke the law...

Governor Rick Perry refused to fund Lehmberg’s office. So on Friday Democrats decided to make a stand for drunk drivers everywhere and indict Governor Rick Perry. On Saturday Governor Rick Perry held a press conference. Rick stands by his decision. Here’s what the governor had to say about the indictment. “Here’s what I think is really important for the people to understand, not just Texans but this country. And, that is, we have seen an office in the form of the Travis County District Attorney’s office. The lead, legal individual for criminal affairs in this county and overseeing public officials...
