CBS tape broadcast of US Supremes | Stuart A. McCreary, Esq.
Wow...after listening to the tape broadcast of the USSC oral arguments, this lawyer is struck by a few things. 1. I have argued a few appelate cases, but sure wouldn't want to be on my feet arguing in this pressure cooker! 2. Justice Scalia was loaded for BEAR! He wasn't asking real questions of Tribe -- no, he was telling Tribe the way it was. NO waffling with this justice. The clear use by the FLSC of the FL Constitution to trump unambiguous dates in the statute is clearly improper and gives rise to a Federal issue. 3. The follow ...

US Supreme court | Stuart A. McCreary
During oral arguments before the Florida Supreme Court, this little exchange to place: Pariente: Could you comment — oh, I'm sorry. Could you comment on the federal statute that was referred to as to whether this court in fact does have the authority? Or are we treading into the separation of powers by making such a determination in this case? Hancock: No, this court clearly has the power. In the Hartke v. Roudebush in the United States Supreme Court, which was another — was a United States Senate election, clearly said that that was a matter that was left to ...
  • A little lesson on what is "arbitrary" in light of the recent Court Ruling

Florida and Federal Law | Stuart A. McCreary, Esq.
This lawyer belives that the DemocRAT lawyers are guilty of the worst kind of spin. I find it incredible that they would think that the judges ruling that the SOS must not reject later handcounts "arbitrarily" is a ruling favorable to thier position. Of course they really don't believe this- its just spin. The case law on what is, or is not an "arbitrary" decision is voluminous and well settled. To overturn an administrative officials decision on the basis that it was "arbitrary" requires the complainant to show that there was NO REASONABLE BASIS for the decision. If the official ...

Bush stands 942 votes ahead of Gore. There are a reported 25 Counties yet to post their new numbers. Of these 25 Counties, only 7 of them have populations over 100,000. Of this same 25 Counties, 19 of them were strongly for Bush in the original vote. It looks good for Bush. These remaining states should hold Bushes lead or perhaps increase it slightly. The absentee ballots should increase the lead as well.

ARE YOU WONDERING why GW left his family to be alone at the Governor's mansion? I think I know and it may be the reason that things have taken such a different turn. My apologies to the non-religious freepers reading along tonight, but surely you must know that GW has a real faith and relationship with Jesus Christ--he said so publicly. Can there be any doubt what George W. was doing alone? We who are of like mind and spirit know exactly what he was doing. He was on his knees submitting to the will of the Almighty. He wasn't ...

  • Wondering about WACO

Hmmm.....recent revelations, new evidence.... It seems to this observer, that none of this is really new. It may be new substantiation, but new evidence?....no I don't think so. If my memory serves me correctly, the congressional hearings held 5-6 years ago had ample evidence of the use of pyrotechnic devices. A few gentlemen, whose names escape me, testified that such canisters were found on the premises - and they were talking about the main compound, not an underground bunker many yards away. This sticks in my memory because that pathetic poseur, and now senator of my state--GAG!,Chuckie Schumer, ridiculed these ...
