On Dec. 28, ImClone reported the Food and Drug Administration had refused to approve its promising cancer treatment Erbitux. Relatives of Chief Executive Officer Sam Waksal reportedly sold shares a day earlier, and so did Martha Stewart. Was that a scandal?

It is also quite clear that the primary evil-doer here is the FDA. The bad news was not that the drug had failed any test but that some unaccountable bureaucrat decided that more irrelevant testing needed to be done.

As a consequence many people who could be helped by the drug will die and many more will lose money.
