A House Divided, Part I: Lawyers And The Degenerate Money Grab

Our nation is at war. At war not only against a terrorist network with a reach around the globe, but at war against a domestic foe, and I´m not talking about the Anthrax threat or the radical greens. We live in a free and just society that comes with rights and privileges that must not be abused, but it appears as if the line keeping our country mighty and strong is getting blurred. As I browse this week´s headlines, several captured my attention, and three jumped out at me, the anti-trust case against Microsoft, the suit filed on behalf of the terrorist group Al Qaeda – filed in a California court by American citizens, and the ongoing case against John Walker (a.k.a. Taliban John). We are at war with ourselves.

Our country´s great systems are under threat from the legal profession. A hundred years ago, even just twenty-five years ago, a lawyer was once considered an honorable profession. Not today. At all levels of society the legal profession is regarded as a parasite. A profession into which we once encouraged our children to enter has now turned into a degenerate money grab.

Lawyers in America have encouraged all sorts of bad behavior by promoting standards where oddball litigation is not only accepted, but is encouraged as tabloid trials rule the media. I could easily name a dozen trials were Media, Inc. has fueled the sensationalism created and nurtured by lawyers. The sad part is that students in law schools are indoctrinated into thinking that this is all performed in the name of freedom. More on that later.

The cases we mentioned above show some great legal tactics. First, the Justice Department has already released Microsoft from the federal antitrust case it was pursuing. Does that stop AOLTIMECNNWARNERNETSCAPE, INC. from filing a case saying that it stifled business related to their holdings? No. Legal intimidation is a great way to harass your business opponents. Legally wear them down until they give in. Besides, we live in a capitalistic economy, I thought that was the way business became successful, being better and stronger, beating your competition is now a crime.

Sadly, I am not surprised by the case filed against the federal government by a group in California. They filed a class action suit on behalf of the Al Qaeda prisoners being held in Cuba. Fueled by an environment where frivolous lawsuits rule the courts, American citizens sue for the protection of the “rights” of those trying to destroy our country. Finally, the legal profession will mount an assault on our elected leaders for daring to prosecute “Taliban John” for fighting against his own country.

A myth needs to be debunked; a lawyer friend of ours makes a strong case that these crazy lawsuits actually strengthen our national resolve and shore up the Constitution. By peacefully settling cases – even fee driven ones like the national tobacco settlement, our lawyer friend says that we place more legal concrete in the foundation of our country. I don´t think so. Using the courts for intimidation, propagation of ideas, or for legislative agendas does nothing but divide our great nation. I take the bold stance that the majority of lawyers will represent anything that comes their way, even if it is a disgraceful cause, using the excuse that lawsuits of all types are good for our country. This is nothing but a front to hide behind, covering the motive for collecting fees – common greed rules the day.

Pursuing the great money grab, lawyers have taken a shotgun approach to lawsuits, by that I imply that sue as many people for as much money as possible. Encouraged by a legal system promoting an anything-goes attitude people will soon sue the pig farmer because their cholesterol is high. The Good Book says that a house divided cannot stand. Will our country be able to stand repeated assaults fronted by attorneys? I hope so. Americans needs to stop the madness and quit crying “Sue!” at every infraction. It is time that Americans let justice belong to the Lord, and not the American Bar Association.
