Hoist by their own petard petard!!! I mentioned this very possibility in one or more posts here several months ago, but nothing seemed to come of it. Now Trump is doing exactly what he ought to do because Clinton and Obama have old homicides kicking around in the records of their presidencies and Joe Biden, whether he is booted out of the presidency now or gets to serve another four years, will be exposed to a host of prosecutions for crimes, including bribery and treason, that arose from his deliberate destruction of the immigration system. The only thing that protects any of those three scoundrels is post-presidential immunity for presidential acts for which they were neither impeached nor impeached and acquitted. This argument is going to give SCOTUS a serious conundrum. Indeed, it ought to give the same conundrum to DOJ.

Not a viable threat. For one thing, the left is looking to get rid of Biden anyway. His replacement has been on order and on standby for some time now.
