Justice Department Launches the National Extreme Risk Protection Order Resource Center

The Justice Department launched the National Extreme Risk Protection Order (ERPO) Resource Center (the Center) which will provide training and technical assistance to law enforcement officials, prosecutors, attorneys, judges, clinicians, victim service and social service providers, community organizations, and behavioral health professionals responsible for implementing laws designed to keep guns out of the hands of people who pose a threat to themselves or others.

“The launch of the National Extreme Risk Protection Order Resource Center will provide our partners across the country with valuable resources to keep firearms out of the hands of individuals who pose a threat to themselves or others,” said Attorney General Merrick B. Garland. “The establishment of the Center is the latest example of the Justice Department’s work to use every tool provided by the landmark Bipartisan Safer Communities Act to protect communities from gun violence.”

FR: Never Accept the Premise of Your Opponent’s Argument

Regarding Justice Department's action, we're witnessing the very corrupt, post-17th Amendment ratification, Biden-protecting Congress once again looking the other way while non-popularly elected federal bureaucrats once again steal state powers, giving the feds more politically correct excuses to interfere is the affairs of the sovereign states imo.

Patriots are reminded that the drafters of the Constitution did not want the untrusted federal government to dream up excuses to stick their big noses, especially federal guns, into the affairs of the sovereign states.

More specifically, the drafters had Constitution had ordered the feds to STAND DOWN to domestic violence unless the state where violence is a problem requests federal assistance to stop it.

"Article IV, Section 4 (4.4): The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence [emphases added]."

In fact, using the word colour, here's what Justice Joseph Story noted about the untrusted feds as it pertains to 4.4 above.

”§ 1819. It may not be amiss further to observe, (in the language of another commentator,) that every pretext for intermeddling with the domestic concerns of any state, under colour of protecting it against domestic violence, is taken away by that part of the provision, which renders an application from the legislature, or executive authority of the state endangered necessary to be made to the general government, before its interference can be at all proper [emphasis added]. On the other hand, this article becomes an immense acquisition of strength, and additional force to the aid of any state government, in case of an internal rebellion, or insurrection against its authority. The southern states, being more peculiarly open to danger from this quarter, ought (he adds) to be particularly tenacious of a constitution, from which they may derive such assistance in the most critical periods.” —Joseph Story, Commentaries on the Constitution, Article 4, Section 4.

Speaking of federal intermeddling in the states, also note that early respected constitutional law expert St. George Tucker had lamented that the legal system was getting "living English common" law mixed up with strict interpretation of the fed's constitutionally limited powers, evidenced by Thomas Jefferson's advice encouraging strict interpretations of the fed's constitutionally limited powers.

Regarding the feds disarming people, the congressional record shows that Rep. John Bingham, the main author of Section 1 of 14th Amendment, had noted that, until 14A was ratified, the states had never expressly constitutionally given the distrusted peacetime federal government the specific power to make penal code, not even for murder!

"Our Constitution never conferred upon the Congress of the United States the power - sacred as life is, first as it is before all other rights which pertain to man on this side of the grave - to protect it in time of peace by the terrors of the penal code within organized states; and Congress has never attempted to do it. There never was a law upon the United States statute-book to punish the murderer for taking away in time of peace the life of the noblest, and the most unoffending, as well, of your citizens, within the limits of any State of the Union [emphases added]. The protection of the citizen in that respect was left to the respective States, and there the power is to-day.” —Rep. John Bingham, Congressional Globe. (See bottom half of third column.)

As a side note to this thread concerning the feds trying to weaken (imo) 2nd Amendment protections, consider that the only power that the states have expressly constitutional given to the feds to dictate gun policy is, ironically, to arm people, no express power to disarm people.

"Article I, Section 8, Clause 16: To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States [emphasis added], reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress;"

On the other hand, note that the feds need to be able to disarm people in conjunction with dealing with people who break federal laws that are reasonably based on constitutionally express powers.

But also consider that state and federal lawmakers will ultimately need to deal with people who are in federal prison for breaking laws, including gun control laws, that the peacetime federal government never had the specific power to make according to the statement by Bingham above.

"From the accepted doctrine that the United States is a government of delegated powers, it follows that those not expressly granted, or reasonably to be implied from such as are conferred, are reserved to the states, or to the people. To forestall any suggestion to the contrary, the Tenth Amendment was adopted. The same proposition, otherwise stated, is that powers not granted are prohibited [emphasis added]." —United States v. Butler, 1936.

The bottom line is that both Democratic and Republican Trump supporters need to support him by IMMEDIATELY primarying ALL state and federal incumbent lawmakers up for reelection, except for MTG, Gaetz & Company (and others?), replacing them with patriot lawmakers who will support hopeful Trump 47 to finish draining the swamp.
