Texas woman who sought court order to get an abortion says she will leave the state for the procedure

A Texas woman whose fetus has a fatal diagnosis and who has been awaiting a decision from the Texas Supreme Court about whether she will be allowed to get an abortion said Monday that she has decided to leave Texas to get the procedure.

Kate Cox, a mother of two who is around 20 weeks pregnant, found out just after Thanksgiving that her developing fetus has trisomy 18, a fatal diagnosis. Seeking to terminate the pregnancy to protect Cox's health and future fertility, she and her husband sought a court order to block Texas’ abortion bans from applying in her case.

A district judge granted the request Thursday, but Texas Attorney General Ken Paxton sought an emergency stay from the state Supreme Court, which then paused the lower court’s order Friday evening.

"Due to the ongoing deterioration of Ms. Cox’s health condition ... Ms. Cox is now forced to seek medical care outside of Texas," Molly Duane, senior staff attorney at the Center for Reproductive Rights, which is representing Cox, said in a court filing Monday.

However, Duane also said in the filing that "because the issues in this case are capable of repetition yet evading review, the Plaintiffs nonetheless intend to proceed with their case."

In a statement Monday, Nancy Northup, president and CEO at the Center for Reproductive Rights, said: "This past week of legal limbo has been hellish for Kate. Her health is on the line. She’s been in and out of the emergency room and she couldn’t wait any longer."

"She desperately wanted to be able to get care where she lives and recover at home surrounded by family," Northup added. "While Kate had the ability to leave the state, most people do not, and a situation like this could be a death sentence."

Yes, this is exactly what this was - a political stunt. She could have simply gone to one of the pro-baby-murder states and had the procedure done. Instead, she chose to make a huge scene.

They aren’t afraid the baby will die. They are afraid it will live and be damaged requiring they actually care for an imperfect child, cost money, and cause one of them to give up a career.

At 20 weeks this is a very painful procedure for the baby. Her child deserves to be held and loved.

She could have quietly done this at any time without going to the court and the media. I wonder which Soros-funded group is paying for her legal case. Leftist baby-killing supporters say that abortion is a private matter, but they sure do insist on making it a public one.

Maybe it’s just me, but I think once she knew she wanted to abort, she could have just taken a weekend trip to someplace, and had it done, and not said anything. Why is this front page news?

I don’t think this is about the procedure, this is about the PUBLICIZING of the procedure.

The Attorney General argued that she is in violation of the law.

If we are honest with ourselves the idea of raising a child with Trisomy-anything is terrifying. It takes strong conviction and a strong support network to overcome that fear and do the right thing.

I don’t excuse her actions but I do feel pity for her. Both for succumbing to her fears and for being used as a political prop.

The Attorney General argued that she is in violation of the law.

Poorly written article, she is only in violation if she kills her baby in Texas, in Cali she is engaging in “healthcare”. In Texas you can use deadly force to protect property in some circumstances. The same act in California is is murder. If a Californian is killed while burgling in Texas does Cali charge the Texan?
