Trump drops bid to move Georgia election case to federal court

Attorneys for Donald Trump have notified a Fulton County court that the former president will not seek to have his Georgia election interference case removed to federal court.

The move comes three weeks after a judge denied a bid by co-defendant Mark Meadows, Trump's former chief of staff, to have his case moved.

Meadows had sought the move to federal court on the basis that his alleged actions were all performed while he was acting "under color" of his role as chief of staff.

Trump, Meadows, and 17 others have pleaded not guilty to all charges in a sweeping racketeering indictment for alleged efforts to overturn the results of the 2020 presidential election in the state of Georgia. The former president says his actions were not illegal and that the investigation is politically motivated.

Trump's filing on Thursday said his decision is based on his "well-founded confidence that this Honorable Court intends to fully and completely protect his constitutional right to a fair trial and guarantee him due process of law throughout the prosecution of his case in the Superior Court of Fulton County, Georgia."

Trump last month notified the court that he may file to remove, which the new filing says was done "in an abundance of caution."

"President Trump now notifies the Court that he will NOT be seeking to remove his case to federal court," the filing states.

I don’t believe it is, JMHO. Not sure why they are not pursing this. Maybe they know something we don’t, but I doubt it.

Appeals of any conviction, should there be one, will do so. But Trump agreed to this, so there will be none on this matter.

On the surface, seems like a strange move to surrender a seemingly powerful card to play.

HOWEVER, Trump plays a sneaky game of chess.

Perhaps he WANTS to lose in state court so that the state shows its Fani (!).

THEN he will appeal in Federal Court and crush them.

(I hope.)

Actually, I don’t see how they can do any of this. He was President, doesn’t he have presidential immunity?

No - if it is in state court, that is where it would stay for the appeals process. “Appeals” do not go to the Federal court system in general, though the US Supreme Court can take appeals from rulings of a State Supreme Court.

Bad advice. Let them refuse to move it yo federal court then appeal. Delay, delay, delay because if this goes to court it ends in conviction since he’s Trump and not entitled to the same guarantees as anyone else.

It’s the smart move. Trump was always smarter.

It is smart because the Feds have unlimited amounts of money to spend on prosecution. Fulton County does not.

And the entire case, being a RICO case, hinges on everyone being tried at the same time.

Something the judge has already said, probably ain’t gonna happen.

The judge used to work for Kemp and Willis. Why he’s on the case is beyond me, but that is for a different discussion. And he’s a rookie.

Something tells me he’s getting advice from folks and that he might be getting told to make certain decisions that would be good for his career as a judge, not to make Willis “famous”.

Powell and another co-defendant have asked for speedy trials, as is their right. If they get them, given the fact that RICO relies on parties knowing each other and working together, then the case starts to fall apart.

And if you haven’t seen it, there’s a video of her attorney in court, absolutely shredding the prosecution over not being provided documents that he is legally allowed to have and the prosecution is legally obligated to provide. I don’t even think the judge knew what he was talking about. But, according to the lawyer, the information Willis is withholding is exculpatory evidence. If that domino falls, everything falls.

Time will tell.

Let’s face it folks, America is cooked and so is Trump. They’re not gonna let him have a win no way no how. They want to bury him literally. They pay someone under the table to do him harm or they’ll bankrupt him completely. I can’t see America surviving all this shit hitting the fan. Specially the hordes of illegal aliens coming from around the world in the multiple tens of thousands. By the time Biden gets reelected because you know the fix is in, his evil administration would have let 40 million illegals in this nation. You can flame me all you want but you know I speak the truth.
