Texas Gov. Greg Abbott promised Saturday to pardon a US Army sergeant a day after he was convicted of shooting a protester to death during a Black Lives Matter rally.

The Republican said Sgt. Daniel Perry, 35, was acting in his own defense when he repeatedly fired his handgun on 28-year-old Garrett Foster as he marched in the July 25, 2020 Austin demonstration.

“Texas has one of the strongest ‘Stand Your Ground’ laws of self-defense that cannot be nullified by a jury or a progressive District Attorney,” Abbott said in a statement.

The governor blamed the Friday conviction on the county’s George Soros-backed Democrat District Attorney José Garza and promised to reign in “rogue District Attorneys.”....."

The DA withheld evidence.

That would make him/her criminally liable in some states.

He was just asking a question. It was a teachable opportunity.
Many do not know how Texas pardons work.
A brief explanation, without the name calling would have sufficed

The Board of Pardons and Paroles can meet the first thing Monday morning and the governor can have the pardon signed by noon.

But why was the prosecutor allowed to go through with the trial in the first place? Yes, most likely Daniel Perry will get pardoned, but why was Garza allowed to keep pursuing the case?

They're not going to stop if they can keep their jobs and keep running dishonest prosecutions. They will use this pardon as justification to keep doing more.

As soon as the protesters illegally surrounded his car and started pounding on the glass, he had every right to believe his life was threatened. The presence of an AK 47 just made the situation even more dire… whether it was pointed at him or not.

Here’s the lesson: if you surround someone’s car and scare the hell out of the driver… be prepared to be run over or shot…. because that is what you are asking for… whether you know it or not. Hopefully they do now.

With all that said….. the laws on this type of thing need to be clearly spelled out. Hopefully this case and others like it will add clarity for everyone going forward.

Did I miss the mention of the affidavit in the article? It’s not a biased article is it? Queue picture of black girlfriend and mention she’s wheelchair bound....

News is mostly propaganda.

It was an ongoing riot, that the Texas government utterly ignored. No National Guard, no restoring order, no Rangers arresting the Revcom organized cell leaders.

Silence...

Does the Texas Constitution allow the governor to dismiss cases being prosecuted in district courts?

Not the man of the hour just yet. All he did was huff up and say something. He said what he -would- do. But I see no ACTIONS of leadership. Has he called the leader of the Probation and Parole Board to his office for an emergency meeting?
Has he called the AG in and directed a criminal investigation into the DA for suppressing evidence?

I am seeing no action, I am seeing empty words. A good man will go to prison for months before anything happens. He will be in with black criminals as the racist guy who shot a BLM protester. Hope he survives long enough for a long slow process that will satisfy the political needs of Abbott.

And this is exactly what these leftist government "Officials" are hoping for. They're very vindictive violent people who wear ties.

Ya tell people they want those of us on our side dead, and some people still can't figure it out.

No, it isn’t in this one. But the affidavit was posted in a thread on this from yesterday. Ill see if I can find it. Basically before the presentation to the Grand Jury, the prosecutors went through the 159 slides the detective had and forced him to remove 50 or so they thought were exculpatory.

The detective argued, was threatened, and forced to show their edited show. He complained immediately, and detailed it in an affidavit.

Foster was a turd in the mouthy little Antifa group that prowls Austin, Sgt. Perry was from over here at Ft.Hood, just trying to make some side money. They made some threats over Foster's death, but apparently know better than to try and come up here to act on them. Best thing for those maggots to do is stay down in their county and out of ours.

“He cannot unilaterally issue a pardon.”

Then he can not issue a pardon.

However, when that axe murderer sought a pardon, she appealed to W and he refused.

Note that they completely left out the dead commie pointing his AK at the intended victim. He was just marching according to the yellow journo.

The Republican said Sgt. Daniel Perry, 35, was acting in his own defense when he repeatedly fired his handgun on 28-year-old Garrett Foster as he marched...

They also left out the fact the "protestors" surrounded and blocked his vehicle from moving, and pounded on the car as if they were going to break into it.

It is hard to imaging a more threatening scenario, than having your car blocked by hostile individuals, as one of then approaches your window and points a rifle at you!

It is so tiring to constantly hear Republicans say what they want/are going to do. Just shut the hell up and do it and announce after it is done. It appears the limelight is more important than the action to these individuals.

Does the Texas Constitution allow the governor to dismiss cases being prosecuted in district courts?

The Texas constitution has nothing to do with the governor picking up a phone and grilling the AG regularly about why this case has been allowed to proceed. The AG has authority to investigate the procedures used by Garza, who rejected the recommendations of the authorities on the scene, and also apparently included witness tampering before the grand jury. If the AG was on top of this from the beginning, breathing down Garza's neck, the case never gets brought before the grand jury in the first place.

This has to be the mentality to push back on the Soros-minded prosecutors. Not "well, we have to let the systen play it out". The system is being used as a weapon against justice.

Yes, it takes time away from other priorities, but it takes much more time to clean up the messes they make, and years put of people's lives.
