Dershowitz to Newsmax: Neither Trump, Biden Will Be Criminally Prosecuted for Classified Docs

Harvard Law professor Alan Dershowitz predicts neither former President Donald Trump nor President Joe Biden will be criminally prosecuted for having classified documents at personal locations.

"I think in the end these allegations cancel each other out. I don't think anybody's going to be prosecuted and I don't think anybody should be prosecuted," Dershowitz said Thursday during an appearance on Newsmax TV's "Spicer & Co."

"Nobody took things home in order to sell them to the Chinese, probably it was mostly inadvertent, laziness, carelessness, maybe in some instances a desire to have material that they could look to help them write their memoirs."

Attorney General Merrick Garland on Thursday appointed a special counsel to investigate the presence of classified documents stored at Biden's home in Wilmington, Delaware, and at an office based in Washington, D.C.

Some of the documents were "top secret," the highest level.

Classified records are supposed to be stored in secure locations. Under the Presidential Records Act, White House records are supposed to go to the National Archives when an administration ends. ***

Dershowitz told Newsmax that changes need to be made to "reduce the amount of classification and make it clearer what presidents can and can't do.

"But one thing I guarantee you, I very rarely guarantee predictions, but this one is a 100% certain prediction – unless new evidence emerges neither of these people will be criminally prosecuted. You'll get reports from the special prosecutors, they'll criticize them, perhaps, but there won't be prosecutions."

Trump’s issue was completely media driven. He did nothing wrong. In fact, I suspect the democrats made up that big pile of crap just to protect biden. Now they will say they both did it and everyone does it.

Big difference is Trump was President and had declassification authority. FBI approved his storage area.

Bide was VP...zero declassification authority. And he stored them unlocked in his garage piled in with other junk.

One hypothesis is that the stink that you are smelling is the deep state wrapping up these documents into never ending investigations that is meant to keep them from the GOP House investigations committees. Corruption coverup 2.0.

Hat tip to Greg Jarrett, who was heard opining to knucklehead Sean Hannity earlier today on his radio show about this coverup theory.

Hur is a scum traitor- in on the whole coup against President Trump, working clear back in 2017 under Rosenstein, obstructing Devin Nunes and other House investigators.

Now you know, why- right now... Biden is not sweating bullets and can say something so utterly stupid like the documents were secure because they were behind his locked garage door. This is the same cool Joe, unfrazzled, just like he was unfrazzled when hiding in his basement during the election, not having to campaign because he knew the deep state would be stealing the election and everything was good to go.

The burden is on the prosecution to PROVE the documents were declassified. The simple act of moving the records proves intent on classification. For Biden, you have to PROVE that Obama didn’t declassify. It’s an impossible burden for prosecution.

Dershowitz, an attorney for whom I have little trust and even less admiration, might be correct here.

The classified docs issues are not nothing, however, and I would be surprised if either was on the 24 POTUS ballot.

Lawyers.

You can find a lawyer to take any side of any question, which is as it should because everyone should be able to have a lawyer that will represent them in their quest for fair treatment under the law.

And Mr.D is wrong because the authority to possess documents, in fact even to see some documents is very different for a vice president than for the president.
