The Senate voted Tuesday to move ahead with the unprecedented impeachment trial of former President Trump after listening to hours of arguments on whether it is constitutional to try a president who is already out of office.
The vote was 56-44.
Trump's legal team said the trial is unconstitutional because he's no longer in office and can't face removal, which is the standard judgment of an impeachment conviction.

How does the legislative branch decide something is Constitutional, according to the Constitution? Is that their role?
The whole point of separation of powers is that the Legislative Branch doesn’t get to decide whether something is Constitutional or not. SCOTUS does that, and Roberts’ declining to officiate over this kangaroo court said it all.

The vote by the Senate was unconstitutional. Only the Supreme Court can decide whether or not it’s constitutional.
