This is beyond ridiculous. The blue state governors are having their revenues, that fun their state and local governments starved from the shutdown just like red state governors. Unlike the federal government, they can’t just print money. With no money to fund their expenditures, they will be laying off their workforce...unless they get money from the fed printing press. They can’t stay shut down and have their governments function...they have NO money, NO revenue without businesses and taxpayers.

They have no weapon in this battle, they are unarmed. They CAN’T stay shut down.

Not in a National emergency, when the Presidential power is "Plenary". This was proven over and over again, especially by Lincoln and FDR. The Constitution is not a suicide pact.

Yes, good point, and this should have been part of the public discourse since this whole thing began.

The states followed the federal administration into the response to the virus, even had their hands out for federal help. The question is will the states follow the POTUS out when he decides to leave. You raise the point that legally he can’t make them - states are not sub-units or servants to the federal government is true.

I read my governor’s executive order laying out a legal basis for why his curtailment of the citizens’ civil liberties was necessary for public health and safety. Therein were many “Whereas’” citing federal law. A question could then be whether once the federal government’s legal action/basis are withdrawn by the federal government itself, or “expire”, what legal impact does it have on the governor’s prior order? And is the mutiny to which Trump referred, based on the powers reserved to the people?

You know where any WuFlu aid sent to this state will go?

Into 1 or more of 3 places: The Re-education Industrial Complex, Medicaid, public pensions and health bennies.

Trump needs to come out today with a hard schedule for reopening America. Thus far nobody, not the President nor any governor has come out with any schedule or plan for reopening the country. It needs to be done NOW, Trump cannot delay any longer.

So the fact we are under a National State of Emergency changes nothing? I believe you are wrong. The Presidents already extreme power is hugely enhanced upon declaring National State of Emergency.

For Easter, a federal judge wrote a luminous decision defending religious liberty

Note the use of the words overbroad and underinclusive. Those can be applied to more than the infringement of religious rights.

If I remember correctly, Trump said that he was the person that declared Emergency Act in each state, and he could be the one that lifted the Emergency orders when he wanted to. The media of course is taking it much further than that and he is just toying with them and making them look foolish. Which for some reason they don’t seem to mind.

If the Democrat Governors really want to ‘slow walk’ the economic reopening in the USA, then they need to be prepared to fund a slow opening themselves.

Once they see the lack of money coming from Washington, they will quickly see the light.

I think you might be missing something. The Courts have broadly interpreted the Commerce clause of the US Constitution to allow the federal government to control all kinds of things.

The Commerce Clause describes an enumerated power listed in the United States Constitution (Article I, Section 8, Clause 3). The clause states that the United States Congress shall have power “[t]o regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes.”
