Andrew McCarthy: Why wasn't Andrew McCabe charged?
Fox News ^ | 16 Feb 2020 | Andrew McCarthy

Posted on 02/16/2020 10:44:13 AM PST by E. Pluribus Unum

The Justice Department announced Friday that it is closing its investigation of Andrew McCabe, the FBI’s former deputy director, over his false statements to investigators probing an unauthorized leak that McCabe had orchestrated. McCabe was fired in March 2018, shortly after a blistering Justice Department inspector general (IG) report concluded that he repeatedly and blatantly lied — or, as the Bureau lexicon puts it, “lacked candor” — when questioned, including under oath.

Why not indict McCabe on felony false-statements charges? That is the question being pressed by incensed Trump supporters. After all, the constitutional guarantee of equal justice under the law is supposed to mean that McCabe gets the same quality of justice afforded to the sad sacks pursued with unseemly zeal by McCabe’s FBI and Robert Mueller’s prosecutors.

George Papadopoulos was convicted of making a trivial false statement about the date of a meeting. Roger Stone was convicted of obstruction long after the special counsel knew there was no Trump–Russia conspiracy, even though his meanderings did not impede the investigation in any meaningful way. And in the case of Michael Flynn’s false-statements conviction, as McCabe himself acknowledged to the House Intelligence Committee, even the agents who interviewed him did not believe he intentionally misled them.

.
It’s 3D Chess.

It only appears to us like there is Double Standard of Justice and the Coup was authorized and Horowitz always denies Intent and Bias, and the accused get very wealthy, very quickly.

The three Year Investigations to run out the clock are honest and sincere.

And Comey is so scared, with his daughter working in the Southern District of NY, and all, he targets the President in his retirement Tweet Trips.

If you have figured it out yet, you ain’t going to.

Why wasn’t Andrew McCabe indicted?

“Prosecutorial discretion”. Don’t want to clog the courts, you know. Wouldn’t be prudent.

...purported lack of intent is McCabe’s principal defense

FBI Director James Comey did not recommend prosecuting Hillary Clinton for mishandling classified information because she had no criminal intent.

The two-tier justice system is sickening and so corrosive to the rule of law and the survival of the republic. The thing that gets me is how blatant these leftist bastards are about it. They parade their two-tier justice right down Main Street in front of us all, flaunting it the whole way, taunting us rubes with screams of "You will NEVER be able to touch us! We are invincible!"

Andrew McCarthy wrote in July 2016:

"FBI Rewrites Federal Law to Let Hillary Off the Hook" here is no way of getting around this: According to Director James Comey (disclosure: a former colleague and longtime friend of mine), Hillary Clinton checked every box required for a felony violation of Section 793(f) of the federal penal code (Title 18): With lawful access to highly classified information she acted with gross negligence in removing and causing it to be removed it from its proper place of custody, and she transmitted it and caused it to be transmitted to others not authorized to have it, in patent violation of her trust. Director Comey even conceded that former Secretary Clinton was “extremely careless” and strongly suggested that her recklessness very likely led to communications (her own and those she corresponded with) being intercepted by foreign intelligence services.

Yet, Director Comey recommended against prosecution of the law violations he clearly found on the ground that there was no intent to harm the United States.

Perhaps Barr knows about other wrongful things McCabe has done and this is not the right time to pursue those things.

Sometimes, timing is everything.

Perhaps the biggest lie in this matter is that there was no reason to rush forward with this one McCabe charge if there are other charges to follow. Why did they feel compelled to address just a single charge rather than to group all violations in one indictment later on down the road is the question that deserves an answer?

“McCabe made a deal. It looks like the DOJ wants Brennan, Clapper and Comey. Strozk and Page will also see indictments and the star witnesses will be the Ohr’s.”

At best that’s wishful thinking.

At worst it’s idiotic.

Why doesn’t the DOJ want McCabe too?

Jury nullification .... looking at the cr@p presented & lying that went on in the Flynn case, I don’t know how you believe anything the government presents. Sidney says she has evidence of a manipulated 302 that the prosecutor says they don’t have - that’s pretty damning ... plus all the other stuff, including trapping Flynn (Comey admitted it). Anyway, if on a jury, I think I’d have a hard time voting to convict based on what has been going on with recent cases. Letting McCabe off is beyond disgusting - everyone I know is seriously pissed about it.

Why wasn’t McCabe charged for lying to the FBI and leaking classified information to the press?

Why wasn’t Comey charged with lying to the FBI and to Congress, and for leaking information to the press, and for and stealing classified documents?

Why wasn’t Brennan charged for lying to Congress?

Why wasn’t Clapper charged for lying to Congress?

Why wasn’t Sall Yates charged for lying to Congress about FISA?

Why did James Wolfe get only TWO MONTHS for lying to the FBI when he should have gotten two years?

I could go on all day with how the Commie Rats are above the law and nobody is going to put anybody in prison for it.

Stinking jackwipes.

Flynn’s case is a bad example for one key reason: You can’t have jury nullification if you don’t have a JURY.

He seriously damaged both his credibility and his case when he pleaded guilty in the first place.

This is what we get after 8 years of 0bama.

He and his team spent every minute of those 8 years installing THEIR people everywhere that counted in order to insure what we have to deal with now.

Also a big nod goes to the many corrupt republicans in DC who are in bed with the corrupt dems and refuse to get to the bottom of anything because it’ll incriminate THEM as well..

In the embedded video, Trey Gowdy says, “We’re not gonna survive if the American people don’t have confidence in the FBI.”

Mr. Gowdy, what planet have you been living on? That ship sailed when Hillary got off for those e-mails. Everything that has happened since only underscores the problem. The FBI & DOJ cannot be trusted. Period. When one cockroach leaves, another takes his place.

“Perhaps Barr knows about other wrongful things McCabe has done”

More likely it is that McCabe threatened to spill all the beans. He was acting director of the FBI after all.

The FBI (Wray) and Justice Department are in full protect mode.
The last thing they want is for McCabe to reveal everything.
That is how the Deep State always protects itself.
it has to to survive.

Guess you could call it a Qud Quo Pro:
You don’t indict me, and I will keep quiet.

Yeah, in Flynn’s case, no jury ... I meant it for other generic cases.

What grates my take on this is Barr remarking to the fake media that he was “happy” DOJ got Stone on those charges.

Say what?

The President can fire Barr and he can then use the Vacancies Reform Act to appoint a temporary Acting AG of his choosing for up to 210 days.

Barr believes in the great power of .gov. He's not one to lessen the powers of the state or hold accountability as a priority.

Why take McCabe on a process crime? There was a coup going on and McCabe was in the middle of it. Get him for that.
