Supreme Court Justice Ruth Bader Ginsburg on Wednesday missed oral arguments due to a stomach bug.
Chief Justice John Roberts, speaking from the bench, said Ginsburg was “indisposed due to illness.” He said Ginsburg would participate in deciding the cases based on written briefs and oral argument recordings.
A court spokeswoman confirmed that Ginsburg was at home with a stomach bug.

In other words his basis for this is whatever he wants his basis to be. It's open for change to suit whatever the circumstances are.
Republican Conservatives will never see that making a religious test on abortion has divided the country more than any other single issue. However, if one believes abortion is equivalent to murder, then it follows you'll consider millions of our fellow countrymen murderers. It saddens me to see our once tolerant nation engaged in this undeclared civil war.
Please God, remove this anti-American abortionist and give us a pro-America, pro-Constitution, pro-Life Supreme court justice in her place.

I have a simple response. Yes indeed! A Trump Supreme Court appointment while he being FAKE impeached will make lefties go nuts like we have never seen.

An POTUS under Impeachment cannot nominate a SCOTUS to the Court. Next year, they'll remind the GOP that nobody will get to choose the replacement in an election year.

There is no coincidence, and I have posting about that since we heard that she had been admitted to a major teaching hospital.
The Biden rule was made up out of whole cloth by Joe Biden when Bush senior was president. It is not part of the Senate rules, it is not supported by the Constitution, it's nothing but an excuse for not acting on an appointment. Absolutely nothing prevents a president from making a Supreme Court appointment in the last year of their term except for an intransigent Senate. McConnell blocked Garland because he could. He could approve a Trump appointment because he can. Simple as that.
She is doing this nation an injustice and disservice by holding onto a government employee position that she cannot maintain.
