AP Analysis: It doesn’t take a crime to impeach a president

If House Democrats press ahead with impeachment proceedings against President Donald Trump, their case will rest in large part on the claim that he sought a foreign government’s help, with hundreds of millions of dollars in aid in the balance, to dig up dirt on a political opponent to boost his reelection campaign.

But, if true, would that be a crime? The answer might not matter. It doesn’t take a criminal act to impeach a president.

The big advantage to a parliamentary system is that minority parties have more power and parties are less entrenched over time.
 
Works for places like Europe, to help keep the goosetepper crowd tamped down.
 
 
But I am unaware of any parliamentary systems that have a strong mechanism to protect individuals rights and stem majoritarian tyranny.
 
Which is one of several reasons why it is incompatible with our particular system of governance.

They are actually, falsely calling what he did a crime as explained below-

nancy is now saying it ‘only takes ‘quid’- no ‘pro quo’ needed’- and a democrat strategist said tonight that noone else gets away with trying to do wrong even if they don’t succeed- so this gives you an idea of how this whole witch hunt is going to play out- the left are so invested in impeachment now that they must move the goalposts ever5y few days in order to keep their hateful dream alive

Their argument/impeachment case’ is gonna be- “Just asking someone to affect the 2020 elections is enough of a betrayal of the united states that impeachment is mandatory. It doesn’t matter if he succeeded or not- it’s still a crime for anyone else to commit, and the president isn’t above the law”

This is the precedent that Pelosi is creating. Impeachment going forward will be a political tool. The Founding Fathers warned us this might happen.

Impeachment going forward will be a political tool.

It's been political before. The problem now is that it is partisan. That means the next R president, if any, will be impeached too. The R party will continue to follow the Constitution and the D's will continue to shred it.

A bigger problem is the involvement of the deep state and the prior misuse of the intelligence apparatus against the opposing party and candidate. The Fouders cetainly never intended to have a federal or indeed global police force.

Quite simply, the Democrats are seeking to reverse and nullify the result of the 2016 election and any excuse no matter now flimsy or or absurd it may seem, is being invoked to advance it.

Donald Trump’s real crime is that he won. This is why Democrats want to remove him from office. The real abuse of power is coming from their side.

Roberts the Obamacare Miracle worker presiding over a Senate filled with corrupt or compromised stooges of both parties. What does the CIA or FBI who have a lot to fear from PDJT have on these Senators? It can’t be allowed to get that far.

Pelosi today and yesterday in any number of interviews mentioned protecting the Constitution and her oath of office virtually in every single sentence. We know that in her decades in office she hasn’t ever seemed concerned an iota about the Constitution or her oath to it. My take: She and her mob are rewriting the document live as needed on the run and the media is totally cooperative.

No crime is required to impeach, only the requisite number of votes in the House.

That is the prevailing view.

But the text of the constitution refers to presidential misconduct as a predicate to the exercise of the impeachment power. So the House could never just rely on a simple majority vote. They would also need to make a finding of misconduct. Even if it's a complete pretext.

But the Federal Courts have historically cited pretext as a basis to invalidate facially valid governmental acts. So in my view this opens up a small window to adjudicate the underlying basis for the impeachment decision. Remember Justice Roberts got cute this summer and basically used this approach via the APA to uphold the ban on the Citizenship Question in the 2020 census.

That being said, the Court will never have the balls to invalidate an impeachment vote on this basis. Even though Kavanaugh and Thomas should know better.

So as a practical matter, you're right. You just need 218 votes.

When the Dems take the WH either by Pelosi’s convoluted complicated conspiracy or by rigging the ballot boxes, Republicans ans the many self-inflated conservatives here will smile, gripe and make much noise, but ultimately just fold, because they are not lawbreakers and have regard for law - unlike Democrats who care not a wit about anything other than their power and will do whatever it takes to keep and increase it - even to destroying the country.

It has always been up to Congress to impeach for a good reason. Today’s congress just happens to be the first to fail to have that. Just keep this in mind:

Many Republicans voted for the Nixon inquiry.

Many Democrats voted for the Clinton inquiry. (31 Democrats, 15% of the Democratic caucus)

The failure to gain any bipartisan support confirms that the current Congress does not have a good reason to impeach.
