Actually, it's the first real offensive step of any substance he's taken since being sworn in. The declaration is going to dominate the news now until it is resolved either in Congress or SCOTUS - could take months.
No one cares about the small print in the bill. Laws are extremely easy to circumvent, challenge or fail to enforce. The nature of the wording was a cop out to allow the proggies to save some face. Consider accompanied children - they can only be processed if caught in the USA. The wall is intended to foreclose that action by blocking their path in the first place.
