The 9th U.S. Circuit Court of Appeals upheld a temporary restraining order against a Trump administration policy that denies asylum to illegal aliens.
The 2-1 decision is the latest setback the 9th Circuit has rendered to President Donald Trumps immigration agenda.
Just as we may not, as we are often reminded, legislate from the bench, neither may the executive legislate from the oval office, Judge Jay Bybee wrote for the majority. Former President George W. Bush appointed Bybee to the bench, and the judge has a conservative reputation.

Congress can AND SHOULD limit jurisdiction of Executive Order challenges to SCOTUS. There are precious few days left to make that happen yet it is the most important thing Congress could do. No District judge should be able to override the Ptesident regarding the exercise of his powers.

A lower court should not have that sort of power. At that rate traffic courts should have veto authority too.
Given alleged Democratic ballot box corruption in 2018 elections, stopping ballot box corruption in 2020 elections is arguably as important as building Trumps wall imo.
More specifically, before 2020 elections, patriots need to support Pres. Trump in working with the states to enforce compliance with the 12th Amendment (12A) and Section 2 of the 14th Amendment (14A) for 2020 elections. Enforcing 12A will put a stop to unconstitutional state winner-take-all laws for electoral votes. Enforcing Section 2 of the 14A will prohibit the states from allowing undocumented Democrats to vote and possibly swing elections.
"The Electors shall meet in their respective states, and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves; they shall name in their ballots the person voted for as President, and in distinct ballots the person voted for as Vice-President, and they shall make distinct lists of all persons voted for as President, and of all persons voted for as Vice- President, and of the number of votes for each, which lists they shall sign and certify, and transmit sealed to the seat of the government of the United States, directed to the President of the Senate [emphasis added]; "
From the 14th Amendment:
14th Amendment, Section 2. Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens [emphasis added] twenty-one years of age in such State."

You can thank Ryan and McConnell for this crap. Neither had the backbone to bring forward legislation to fix our poor immigration laws. Now, nothing will happen for at least two years because of Dem control of the House, although Repub control under Ryan was almost the same. Ryan’s real masters were not the Republican rank and file, but the Koch brothers, Chamber of Commerce and other cheap labor advocates.

I agree that the President cannot make laws.
The problem is “we” have far too many “G.H.W. Bush”es and far too few “Donald Trump”s! We’re so civil the other side rules even when “we” are in powers. Then they wonder why folks get discouraged about voting Republican...

Law is law. Law and order is out the window right now including election laws. Law and order has broken down under our very own trifecta.
Why should we be forced to pay higher taxes because of illegal aliens? Can we forgo the IRS laws requiring us to pay taxes?? Of course not.
The laws benefit one side only.

The acrobats within the 9th Circus are frequently overturned.
Address an official document to the 9th circuit that if they want their ruling enforced, they will have to deliver the enforcement personnel to do so. The current federal government agencies will not.
