Former US Attorney Joe diGenova told Fox News host Laura Ingraham Tuesday evening that if Mueller issues Trump a subpoena we are headed to a Constitutional crisis.

As reported earlier, Mueller warned he may subpoena President Trump.

The Washington Post reported earlier Tuesday Mueller raised the prospect of presidential subpoena in a recent meeting with Trump’s legal team.

In a tense meeting in early March with the special counsel, President Trump’s lawyers insisted he had no obligation to talk with federal investigators probing Russia’s interference in the 2016 presidential campaign.

But special counsel Robert S. Mueller III responded that he had another option if Trump declined: He could issue a subpoena for the president to appear before a grand jury, according to four people familiar with the encounter.

Mueller’s warning — the first time he is known to have mentioned a possible subpoena to Trump’s legal team — spurred a sharp retort from John Dowd, then the president’s lead lawyer.

Mueller is out of control.

I think Trump should simply refuse any subpoena from someone who works for him.

I don't believe the subpoena would be from Mueller, but from a Grand Jury. The Grand Jury is not an organ of the Executive Branch, but the Judicial. Basically, Mueller presents evidence to them and asks them to issue a subpoena.

CNN pundits are emitting awhile lottabilge waterabout hororing the rule of law right now. Also no man is above the law.

I suppose what makes this different from Nixon is that during the Nixon era I did not know that there was an alternative point of view.

I am also uncertain how this time is different from Clinton although I think perhaps there were specific charges against Clinton made by Lewis my. If so then I wonder if specific charges by comet count as directly analogous. Wouldcomeys wordalone be sufficient to charge trump with a crime?if so then how could any future president have a closed door convo with an underling?

Another question, just because trump tweets somting in the political arena, is it regardedadany kind of evidence of anything at all presuming it isnotslander / libel? What if I run for political office under the banner two chickens in every pot but someone subsequently gets only one chicken in their pot? Could I be convicted of a crime? Isn’t that political? And certainly under the Roberts USC, don’t the courts have a duty to honor the democratic voting process and leave politics strictly out of the courts?

Lets pretend that the SC says that the Pres can be subpoenaed and Mueller does so. Trump refuses. What happens next? Does the FBI or Marshalls come to arrest Trump? Or he does comply and testifies by saying nothing. Then what? There is no Constitutional crisis.

All paths lead to the Congress and Senate. There is a well defined way to handle a criminal president. Or even a disliked honest one.

I wonder what the threshold opting requirements are for the grand jury?

If it is a DC grand jury would that be enough to guarantee unanimity if unanimity were needed?

How come Hillary was able to avoid all of this??

Unless the President takes a tough stand against the people who are trying to take control of the Executive Branch, this will continue. I cannot imagine what is taking him so long.

He is so strong in so many other areas. He has got to pull back and use the powers that are his to use. Forget the political implications, DO SOMETHING PRESIDENTIAL to save those powers and the republic.

I imagine there would be an immediate appeal to SCOTUS and this thing would grind through the legal system for the rest of Trump’s term.

It would just become another Democrat bloody-shirt talking point.

It's not even a bluff. The media reports describe this as a suggestion made by Mueller at a "recent" meeting ... but then they point out that the meeting took place TWO MONTHS AGO.

Mueller's chances of getting any cooperation from Trump evaporated when Cohen's office was raided.

The Deep State is dragging this out to the November elections. There have been at least two “seditionists” who have “threatened” that there is more to come. What do they mean? Meanwhile, Republican Establishment leaders sit and watch.
