Opinion: Robert Mueller’s Last Resort

It’s a nightmare scenario, but it’s not hard to imagine: President Trump, growing tired of the Russia investigation as it closes in on him, fires Robert S. Mueller III and moves to dismantle the Office of Special Counsel.

This would be a serious assault on the rule of law in the United States. The ability of the Department of Justice to enforce the laws would be in grave doubt. By now, Mr. Mueller has presumably amassed a great deal of evidence, some of which is highly classified, that may point toward serious crimes. Americans might reasonably wonder whether perpetrators, if they exist, would ever face justice.

We hope that such a constitutional crisis is unlikely. But if it does come to pass, there is a way that Mr. Mueller and his staff could prevent their important work from being permanently buried: They could become lawful whistle-blowers.

Many people think that exposing classified misconduct requires breaking the law. Not necessarily. If Mr. Mueller is fired, he and his team would not have to do anything illegal to disclose classified information and ensure that the American people learned the truth.

Here’s how it could work:

The moment he was dismissed, Mr. Mueller could lawfully take all the evidence he had collected — even the most highly classified materials — straight to Congress. If he personally lost access to the evidence, a remaining member of the Office of Special Counsel could do the same.

It’s an issue completely under Trump’s control. Mueller has nothing. Rosenstein has stated publicly that Trump is not even a target of the investigation. More details about the origins of the anti-Trump conspiracy surface every day; inexorably the full corruption of Hillary Clinton’s dirty tricks squads will be made visible to all.

These reporters are simply desperate and it shows. Here’s an equivalent scenario to their idiocy:

Mueller has interviewed a lot of people.
Therefore, he may have proof that John N. Tye and Mark S. Zaid are serial killing child molester cannibals. Or not, but PRESUMABLY he does, because fantasy and presumption of guilt are the new legal standards.
Were they to be charged and even prosecuted for crimes we have zero evidence that they committed, Hillary might pardon them after becoming President, if Trump resigns and Mike Pence picks her as his VP then resigns too. Let’s organize mass riots just in case.

Laughable. The DOJ is not supposed to be independent OR stand in judgement of the Presidency. It is not an assault upon the rule of law because at any time a President strays out of ethical bounds, Congress can remove him from office as quickly as needed.

It’s a far better system than setting up the DOJ a as 4th branch of government, independent of Congress and the Executive branch.

Yes, they could. But then, they would have to show they had standing to pursue the suit, and the defendants (Trump team) would have the immediate right to enter into discovery and rake them over the coals in depositions and requests for information in order to immediately find out if they really have anything or not. And, the Mueller fishing expedition would be over.
