Yeah, in my current State of residence you could not legally use deadly force against him simply running away or for simple property crime. You can only use deadly force if you believe your life or someone else's life is in danger - including "just" significant bodily harm.

However, the way my house is someone running from me on the ground level, even towards the front door, is also running towards the steps leading upstairs to the bedroom level. If my wife or kids are home, I don't know that he's not heading for the stairs to take a hostage or worse. He's going down. At that point I know he is a criminal, know he is panic'd and not thinking clearly, know he is adrenaline-strong, and I therefore reasonably believe he represents a deadly threat to my family members who he is running towards. End of story.

I would not use my gun to defend property outside my house. That said, I’m not shedding any tears over the perp in this story.

So the criminal had the right to just waltz right in and take what was “rightfully” his? And the normal person didn’t have the right to defend himself?

If the trial is before a jury of women who watch oprah and the view, the homeowner will lose.

Lawsuits like this one happen when you defend home and property with lethal force.
The crime involved has nothing to do with the civil suit.

If you carry and have to defend yourself, you WILL be sued, either by the family, who pretty much are looking to cash in or by the guy you shot, also looking to cash in.

Find a lawyer that specializes in self defense cases, KEEP HIS CARD WITH YOUR PERMIT.

Check your homeowners policy on coverage, add a rider or get better coverage, pronto.

Mine cost me $10K in lawyers fees, but the perps wife didn't get a dime.

How does the wife looking for a payday know that he was “clearly” unarmed? Was she there and what’s up with alleged burglar, what was he doing in the guys car putting something in it?
