Democratic leader Sen. Chuck Schumer says any effort by President Donald Trump to use military funding to build his border wall be blocked by lawsuits, according to the Washington Post.
The Washington Post reported that Trump is pushing military officials to shift a very small portion of their $700 billion 2018 budget to build up border defenses, and quoted Schumer saying:
This would be a blatant misuse of military funds and tied up in court for years. [Defense] Secretary Mattis ought not bother and instead use the money to help our troops, rather than advance the presidents political fantasies.
Schumers threat came after he worked with GOP leaders to allocate only $641 million for the construction of new border fences in the 2018 omnibus bill. The bill also includes language which bars Trump from spending money on the concrete-and-metal prototype walls which he touted in early March. According to the Post:
Trump, who told advisers he was spurned in a large spending bill last week when lawmakers only appropriated $1.6 billion for the border wall, has begun suggesting the Pentagon could fund the sprawling construction, citing a national security risk.
After floating the notion to several advisers last week, he told Speaker Paul D. Ryan (R-Wis.) that the military should pay for the wall in a meeting last Wednesday in the White House residence, according to three people familiar with the meeting. Ryan offered little reaction to the notion, these people said, but senior Capitol Hill officials later said it was an unlikely prospect.

The midnight to 4 am syndicated radio show “Red Eye” is reporting that the Chicago Tribune has reported that someone in the Pentagon told their reporter that the President would have to submit the change to the Senate and it would require 60 votes to approve the change the President recommended.
Who defines “loser”?
Say both the Plaintiff and Respondent sink $100,000 in legal fees into a $1,000,000 lawsuit. And let’s say that — when the dust settles — the Judge rules that the Respondent is only on the hook for $100,000 — who lost?
The Respondent escaped 90% of the claim he was sued for.
The Plaintiff only won 10% of the claim he sued for.
A judge could easily look at the money and say that the Plaintiff who spent $100k to essentially break even “lost” his case; that the Respondent who spent $100k to avoid paying $900k more is the winner, and therefor the Plaintiff has to pay the Respondent’s legal fees.
I heard this also. There is no excuse why the wall was not in the omnibus bill. It should have been vetoed without it.

That deep state Pentagon official doesn’t know what he’s talking about. The only limits in the bill related to the $1.6B allocated for fence extension and repair - so if Trump tried to fund wall with that money, then sure, he needs the 60 votes - but to use a chunk of the $725B allocated to the DoD, he doesn’t need squat.
This unnamed official is simply lying in a futile attempt to deter Trump from using his rightful executive powers as CiC over the DoD funds available to him for any legitimate national security project, which certainly includes a border wall.
